Not necessarily, even “if” this happened as the illegal claims there would have to be proof of willful negligence and malicious intent for the agent to be deserving of jail. This is a civil suit and there are no criminal charges involved. It may well have been a matter of not expecting the train to begin moving or, in the heat of the moment, not realizing one’s situation relative to the track.

Unfortunately, the illegals have found out how to play our legal system for fun and profit. No wonder the BPs get paid so well, they have to put up with a lot of grief.
This sounds more like the kid in Marine boot camp around 1969 who wrote to his mother who then wrote to her congressman (follow the chain of stupidity) telling mom that the DIs were being really mean to him and that one DI had put him in a Dempsy Dumpster and shot a flame thrower at him. Ending this chain of stupidity and lies was the congressman who initiated an official congressional inquiry.

Think about it. If I had had the misfortune to be born in Mexico, I like to think that I would have the fortitude to cross the border into the US. And that I would have the courage to do so in any way I could, legal, illegal if that didn't work, but I would get here.
I suspect that if you stop for a moment you would like to think that you would do the same, rather than live with your wife and children in the squalor and no hope of Mexico.
It's what self-motivated people do.
We're on THIS side of that border, and it's our job to keep them out. But we shouldn't forget that most of them are humans too.
If this happened as the illegal claims, I don't understand how the border agent escaped injury. How do you get close enough to the tracks in order to hold somebody's leg down on it while a train rolls over it, and not put yourself in grave danger?!?!
I live in San Diego and keep on top of the border and illegals issue and have not heard or read of this.

I hope you’re right, but it was sent out by a border agent group.
Oh please. Self motivated people in Mexico and Latin America get an education and they do just fine after that.
But coming to America and cleaning tables is so much easier and in the end gives them a life time of benefits that the entire world envies.
I can show you places here in the US that used to be quite lovely before the Mexicans who can't break out of that "squalor" mentality left the areas and homes TRASHED!

If you Google the name of the atty. you see he would be the type to handle this kind of case but see nothing that he is.
