SAN DIEGO (CN) - A Border Patrol agent held him down while a train ran over him and cut off his foot, a Guatemalan immigrant says. Oswaldo Vanegas says his leg had to be amputated below the knee and he lost parts of two fingers when he tried to free his foot.
Vanegas says he fled after the agent found him and others aboard a freight train near San Ysidro. He says the agent tackled him and he fell onto the tracks beneath a stopped train.
"As the train began to move, the Border Patrol agent held onto Mr. Vanegas. The agent prevented Mr. Vanegas from moving off from the tracks towards safety," according to the federal complaint.
Illegal immigration to the U.S. has been on the decline since August 2007. Anti-immigration groups say heightened border security explains the trend. Economists and demographers point to the weakened economy.
Vanegas is represented by Matan Drelich. He demands $10 million.

I doubt any of this is true. I also doubt this poor agent will get a fair trial.

My guess is mr illegal immigant resisted as being removed from train and ended up through his actions getting his lower leg and fingers severed. There are two sides to every story.
If the agent did hold him down I expect appropriate charges to be filed.
Wanna bet any witness for his story is an illegal.

I don’t believe it for a second. It must be common knowledge in latin America that the gringos are chumps.
As long as the border cop did not alter the evidence, I’m betting the cop is in the clear. No way he would have held anyone under a train.
If America ever gets back to a semblance of sanity, here is how these cases should go:
JUDGE: Mr. Vanegas, are you in this country illegally?
MR. VANEGAS: Yes, your honor.
JUDGE: Dang. That’s tough. Case dismissed!
I am not sure how your leg is held on a track by someone and the person doing the holding is not injured as well. It is more likely he was trying to escape while playing chicken with a moving train.
So this illegal alien who was INVADING the USA wants the American taxpayers to FOOT THE BILL for his injuries which in all likelihood were incurred when he was resisting apprehension?!?!

Lots of big ifs here. If this happened as the illegal claims, then the border guard should be thrown in jail.
