Lower courts have rejected claims that Barack Obama is not a natural-born citizen and thus cannot hold the office of president.

Reporting from Washington -- Undaunted by the Nov. 4 election results, several persistent plaintiffs have pursued lawsuits asserting that Barack Obama is constitutionally ineligible to hold the office of president because they say he is not a natural-born citizen. Their claims were rejected in lower courts, but they have filed motions and appeals to the Supreme Court.
What do these lawsuits say?
One filed by Philip J. Berg, a lawyer in Lafayette Hill, Pa., asserts that Obama was born in Kenya, even though the president-elect has a birth certificate from the state of Hawaii showing he was born there Aug. 4, 1961. A second, filed by Leo C. Donofrio of East Brunswick, N.J., asserts that neither Obama nor his vanquished opponent, Sen. John McCain, are natural-born citizens. (McCain was born Aug. 29, 1936, in what was then the U.S.-controlled Panama Canal Zone.) "Even if it were proved [Obama] was born in Hawaii," he is not a natural-born citizen, Donofrio claims, because Obama's father was born in Kenya. But under U.S. law, people born in the U.S. are natural-born citizens.

No they haven't. They dismissed the cases on grounds of lack of standing - never getting into the issues of the case.
The LA Times gets everything wrong. Why start being accurate now?

In 2000, the same fate befell three Texas plaintiffs who sued George W. Bush and Dick Cheney on the grounds that both were Texans and that the 12th Amendment says the president and vice president “shall not be an inhabitant of the same state.” The lawsuit was thrown out for lack of standing.’

One way or the other, I can’t wait for this to be resolved and go away. Isn’t Philip Berg a 9/11 truther?

I do believe you are right on that.
SCOTUS needs to do two things; 1. Define “Natural Born Citizen” and 2. Task Obama to come up with all his missing documentation to show he fits the definition. Then case closed. Either he will be sworn in or he goes back to organizing communities.

My guess is that they will treat this as a political question. No doubt that Obama’s citizenship is questionable, but 63,000,000 people have just voted for him after his being —IMHO—handpicked for president by the American Establishment.
I guess they are referring to the illustrious FactCheck.org document that no one has seen except pro-Obama partisans, because the State of Hawaii has never exclaimed that he was born there.

Yet the MSM had not covered the story earlier, and now at the 12th hour, here they come, debunking instead of looking at the actual arguments. Why didn't they report Obama's million dollar financial expenditure to obscure his birth document history?
Thankfully the SCOTUS standard is not he same as the LA Slimes journalistic standard, or we would long ago be living in a country called AmeriKanistan.

Yes the guy pushing this is a 9/11 truther. No surprises since the BC story is the right wing equivalent of the 9/11 truth “movement”. I think if you go for the “Obama was born in Kenya” package, you might want to consider the “Bush blew up WTC” deal.

we are last I looked a nation of laws, and mr. o has defrauded more than half of America. If he is inaugurated, he has defrauded all of America.
The Leo Donofrio case and Cort’s case are the better cases.
The good news is LA Times aka Tribune just declared bankruptcy.
I still have faith in Thomas, Scalia, Alito and hopefully Roberts. I have more faith in them than the GOP and obviously the Dems.
We need those 4 to move Leo’s case along. If that happens hopefully Kennedy will “get it” as well.
Either Constitution means somethinbg or it is worthless.
