I asked the same question some time ago. Perhaps ages ago, as part of the checks and balances system, they would have. It sounds logical to me, anyway. The response I got from my inquiry is that the SCOTUS only responds to a fraction of the cases as they make their way up from lower courts. They do not (at least not anymore) “look for business” on their own. It’s a shame ... you’d think it would be a priority to keep eyes open for crisis issues like this and head them off before the pot boils over. Still ... they are swamped in the same way as every other court in our contemporary compassionate legal system. The plate is only so big, and it is filled. I do hope, at least now that these cases have filtered up, they will but a great deal of priority on it now.

Yes, I don’t think they’ll actually have the guts to catch Bambi in their net.

But let a chance to address an unaddressed passage in the Constitution? And leave hanging the idea that they can’t enforce the Constitution if Congress hasn’t seen fit to right the applicable laws? Not a chance.

Welp, somebody, somewhere needs to be responsible for the vetting of presidential candidates.

I've asked my State Representative to introduce a law that will require the Sec of State to vet all Presidential candidates, to include personally viewing original birth certificates, before placing their names on the ballot. It would only take one official to uncover a foreign born fraud.

His BC wasn’t sealed by Gov Lingle. World Net Daily claimed that it was but the Director of the Hawaiian Dept of Health said all birth records are off limits except to the parties involved. WND was incorrect.

This country is a republic, not a democracy.

This is getting into issues well beyond this thread, but I don't believe that the two concepts are incompatible. If, for instance, the majority voted to restrict the participation of certain groups in the political process, that would be an issue worthy of supreme court review because the political process could not adequately resolve the issue (because the offended group has been barred from participating in the process). What I said before was perhaps inartful. Maybe I should have said that the Court can become involved essentially to ensure fair play in the political process, but only in those circumstances in which the political process couldn't adequately resolve the problem itself. For instance, if a state legislature votes to make a public school male-only, I would contend that the courts would have no business in reviewing that action because the political process still works and the public is free to take action to make a change in the legislature, if necessary. If the same legislature voted to deny the franchise to women, that would be an issue for the courts because that affects the fair play of the political process. I think this approach is one of the few ways that a court can take cases that don't veer into the realm of "judicial activism." It becomes far too difficult in the former category of cases to make decisions without injecting personal political bias, and I think that is a problem with the judiciary.

Obama needed to tighten as much of a noose around the Hawaiian Dept of Health as he could. That would mean big payoffs to Lingle and the head of the DOH. The danger to him is that anyone who works there could get a copy of his BC and circulate it for forensic analysis (it’s likely to be a forgery by this time anyways). The real key is the doc#, and the surrounding doc#’s, because if it’s a fake document # then he’d be using someone’s who died at that time, and he restricted the time of birth on the fightthesmears website. Once the document sees daylight, guys like Polarik will prove it’s forged.

Applying Occham’s Razor: Is Obama acting in an open handed fashion, delivering requested documents to whomever asks, just like McCain did? Or is he operating in a secret fashion, hoarding info to himself and dealing with the heads of the departments to keep things quiet? Which scenario describes this situation better right now, the open handed or the close handed one? Of course, there are other possibilities, this isn’t a false dilemma, but it does serve to open one’s eyes to his methodology.

That is a shame....they should PRIORITIZE their decisions based on the most egregious CLEAR AND PRESENT DANGER to the Constitution itself. Staggers the imagination really....

I am cool with that. It doesn’t matter when. The mess lies 100% in Obama’s lap. So, maybe it will help out in the next election. It will still be a mess. The American people will not be deterred by a little mess. We’ll see it through.

You’ll have to take back one of those statements if you intend to be taken seriously. Even then, the damage is done to your reputation. You opened your mouth before you thought, and your word is no good.

Think of the “nerdiest” kid in your class at school.....The nine yearold that has a science fair project even the judges don’t get....Or the Kid that plays and know all about the classic musicians...

Put a Constitution in front of them, a law degree in their pocket add a huge ego and multiply it by nine,= SCOTUS!

It’s their chance to MAKE history! They’ll do it right! Bells, whistles, etc. etc. Just like that outstanding science fair project or perfectly played concerto.
