The justices of the U.S. Supreme Court will tomorrow discuss whether or not it should take up the case of Leo C. Donofrio, Applicant, v. Nina Mitchell Wells, New Jersey Secretary of State, a case that challenges the citizenship of President-elect Obama.
After the Justices meet -- and assuredly decline to hear the matter -- the anti-Obama activists supporting the case will hold a vigil near the steps of the highest Court in the land.
The theory -- which is without evidence -- is that Mr. Obama's birth certificate is faked, and that he was not born in Hawaii but rather Kenya, making him ineligible for the presidency. (Or, alternately, that the birth certificate proves only that Mr. Obama was born at some point, not that he was born in Hawaii.)
The Obama campaign says that's nonsense, that he was born in Hawaii, has a birth certificate, and is a natural born U.S. citizen. Period.
As Hawaii's Pacific Business News reported in October: "The director of Hawaii’s Department of Health confirmed on Friday what Barack Obama has been saying all along: the presidential candidate was born in Honolulu. 'There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate,' said Chiyome Fukino. 'State law prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.' Citing her statutory authority to oversee and maintain Hawaii’s vital records, Fukino said she has 'personally seen and verified that the Hawaii State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures. No state official, including Gov. Linda Lingle, has ever instructed that this vital record be handled in a manner different from any other vital record in the possession of the State

If the Supremes decide not to hear the cases before them, the battle to upturn the election is virtually lost this time around. Once Obama takes the oath of office, whatever he did prior to that becomes irrelevent; the only recourse is impeachment and we have discussed that.
You can make a lot of noise but the oath effectively makes him the CINC.

I am anxious to see Obama’s birth cert.. If he is legit then I’m satisfied and will move toward seating a simple majority in the House 2012. All he has to do is open up all his files for public scrutiny. Then we clap hands and end this debate.

But what does it say? Obama's born-in-Indonesia sister has a Hawaii BC as well. The fact that in Hawaii, you can get a BC without being born in the US is being intentionally obfuscated by the likes of ABC.

You are dead wrong. My son-in-law was born in Europe to an American mother, and while he is a citizen, he is not a Natural Born Citizen. LOOK UP THE LAW.
He went in the door before the door monitors would have normally arrived, and once arrived, his race combined with his politics acted as immunity. Yet he has made few missteps, an his team’s version of Nixon’s “modified limited hangout” has been a very limited hangout, and he has had no “deep throat” insiders turning against him. It helps that he has almost no public record, almost no time in public office of interest. And before that he was in in very close circles. Very very close.
It’s interesting how all the links to the text of the Nationality Act of 1940, sections 15-18, which supposedly deal with the loss of citizenship issue at hand are broken and, according to the Cornell website, the library of congress provides only as far back as 1995 in electronic form. Unfortunately I don’t have a full law library at my disposal, so I will have to wait and see what the Supreme Court does with it.
I suspect that there may be some rational leagal question to the whole thing that needs clarification, otherwise the justices would not waste their time or reputations on it.

What birth certificate? Methinks this guy doesn’t know what he’s talking about. No one has said Obama’s birth certificate is fake, because no one has ever SEEN Obama’s birth certificate. Plenty of people have said his Certificate of Live Birth is fake, but that’s not a birth certificate.
Didn’t journalists used to have to investigate their stories instead of just post a bunch of opinions?
