Three weeks ago, I blogged here about the darkly hilarious conspiracy theories bouncing around the blogosphere about whether Barack Obama is a "natural born Citizen" eligible to serve as president. Speaking to an unsubstantiated "what if he was born in Kenya and not Hawaii?" I said that it seemed the relevant statutes governing foreign-born offspring of one citizen and one alien parent were on Obama's side. I based that quickly drawn conclusion on the reading of the statutes provided to the Chicago Tribune by UCLA law prof Eugene Volokh. He has now offered a correction, saying he misread the law when speaking to the Trib, and it appears that he did misread it

Volokh goofed, this guy did too, and we expect them to decide if O is eligible? He also ignores his dual status at birth, which makes it irrelevant where O was born...

I still think this is no court's business, as I said three weeks ago.

Then whose businss is it??? The Democrats or the FEC should have documents in their files verifying the eligibility of each candidate, but apparently, they don't.

IT’S NOT OUR RESPONSIBILITY TO SHOW THAT HE WAS BORN ON FOREIGN SOIL. IT’S OBAMA’S RESPONSIBILITY SHOW US THAT HE WAS BORN IN THE UNITED STATES OF AMERICA!

As I understand it O swore his allegience to another country when he was younger...if that can be shown it might be worth something ...

I really think the best that can come of this is to embarrass Barack for putting out a phony document. Isthat how he will handle all his problems?

He didn't goof. He knew it was a lie, and that he would have to retract it.

Retractions are printed way after the want ads.

I’m sorry, I was under the impression the President Elect had to prove that he was a natural born citizen, not that we had to prove he wasn’t.

There does not have to be a conspiracy, they all go to the same schools and are taught by the same tenured professors.

Are you saying that if the fact (?) alone that Kenya recognised B.O. as a citizen at birth disqualifies him for the presidency according to US law?

I am still waiting for somebody to provide something more than an opinion piece that clearly states how dual citizenship disqualifies someone from being POTUS. It isn't in the Constitution - the 14th Amendment 'jurisdiction' clause notwithstanding. Since the COTUS explicitly states the requirements for the Office of President any additional requirements short of those imposed, explicitly, by a Constitutional Amendment would be, in fact, unconstitutional. As to the application of the aforementioned 'jurisdiction' clause, everybody that is not a diplomat, Indian subject to tribal law, hostile alien occupier (La Raza?) or incidental transient (just happened to be flying through US airspace, for example) is 'subject to the jurisdiction' of the US. Ever heard of Diplomatic Immunity? It is exactly this jurisdiction issue. Does any normal (non diplomat) person have Diplomatic Immunity at birth just because their parent or parents happen to be citizens of some other country? So if the wife of the Chinese Ambassador happens to give birth on the White House lawn during a Presidential Tea Party, that child is not 'subject to the jurisdiction thereof' as it is the child of diplomats, but virtually everybody else in US territory is.

The only Constitutional qualification that might prevent Obama from being eligible to be POTUS is the location of his birth, which, I am becoming convinced by his continued stonewalling, was not Honolulu.

That isn’t good enough. Obama needs to be barred from the presidency so McCain may move into the Oval Office with Gov. Palin as his VP. Then she can become president in 2013, or sooner upon McCain’s death or inability to serve.
