While that's an interesting take. I've always understood the whole ticket gets disqualified and not just the ineligible party. To be honest, I think that the DNC should be totally removed from the equation because they pushed for an ineligible candidate. They failed at vetting him so why should they reap the benefits of the popularity of 0?

And to be fair, I'm not that thrilled about McCain but that in itself is another issue entirely.

I wasn't sure either so I re-read the Constitution. Amendment XII (that's 12). The Electors do distinct ballot for prez and VP and certify the results. Then they submit both lists to the President of the Senate (Dick Cheney). Cheney reviews and I assume determines if the lists are accurate, certified by the electors and, hopefully, whether the winners are qualified under the terms of the Constitution. He opens the ballots in the presence of the Senate and the House of Representatives. The SCOTUS will have to determine whether a ballot electing an unqualified candidate and that has been certified by the electors can be set aside. The state electors are party hacks and will certify Obama’s election even if he is unqualified because they don;t give a rip about the constitution. They want their man. The issue before the SCOTUS is what to do when a Party DNC decides to, en mass, violate the terms of the Constitution. One would hope the conspirators would go to jail...

It will be an interesting two weeks.

The interesting problem is that Biden’s electoral ceretification will be valid because he is qualified to serve (maybe not mentally, but that's another issue). We could see McCain as president and Biden as VP. That leaves Hillary in a quandary but S of S under McCain/Biden Grand Coalition government would actually make some sense. McCain is a one termer and she likely cut a deal with Biden that she will run in 2012 or at least be running mate.

We looked at Condi as president and VP so why not keep Hillary warm as S of S and see who comes out in front in 2012.

This is why all of the Washington insiders are lining up in the new administration. Barry is likely out of the picture unless he produces the qualifying birth certificate. Which, by the way, seems like such a simple solution that I can't believe he's dragging his feet on this issue. The very fact that the SCOUTUS needs to meet is news and the world is watching.
