Supremes to review citizenship arguments-Case challenging candidacy set for 'conference' of justices

A case that challenges President-elect Barack Obama's name on the 2008 election ballot citing questions over his citizenship has been scheduled for a "conference" at the U.S. Supreme Court.

Conferences are private meetings of the justices at which they review cases and decide which ones to accept for formal review.

This case is set for a conference Dec. 5, just 10 days before the Electoral College is scheduled to meet to make formal the election of Obama as the nation's next president.

The Supreme Court's website listed the date for the case brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, over not only Obama's name on the 2008 election ballot but those of two others, Sen. John McCain and Roger Calero.

Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President; and Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936

Three problems here: The oblique reference to Socialist Roger Calero, who is not even a citizen of any kind; the contention that John McCain was born on a base in the Canal Zone, when his birth certificate clearly shows he was born in Colon, Republic Of Panama; and the strange assumption that this Resolution can determine Constitutional issues without adjudication. This would represent a usurpation of powers reserved to the Judiciary branch by the Legislative branch.

This version was sponsored by MCaskill, and cosponsored by Senators Leahy, Obama, Coburn, Clinton, and Webb. This resolution was Considered and agreed to on April 30, 2008.

Despite his reputation and his many admirers on FR, Tom Coburn is no ally of conservatives, I'm now firmly convinced. What are the chances, that both major party presidential candidates would be in favor of undermining national sovreignty by favoring liberal citizenship requirements for illegal aliens, and also undermine national sovereignty by being of questionable eligibility for office under the Constitution? They're both globalist shills, and so is anyone who voted for this.

The problem with Benjamin's arguments, Donofrio's, etc. is that they are all looking for a strict and technical and therefore narrow reason, under the law, that Obama is ineligible.

But, since Obama won the election by a decisive margin, and no one wants riots, the SCOTUS will look at the widest interpretation possible to validate his "natural born" status.

They won't try to argue the strict merits of the case before them -- they will look for any way out, that leaves Obama as natural born citizen. The plaintiffs have to be able to answer a hundred different points of law. Failing to nail even one or two will give SCOTUS the wiggle room to declare Obama natural born.

Here are the alternatives:

* BORN IN HAWAII -- he's natural born citizen since he was physically born in US. All other complications are irrelevant.

* BORN IN KENYA, PARENTS UNMARRIED AT THE TIME -- natural born, just like McCain, since Obama's only legal parent was a U.S. citizen.

* BORN IN KENYA, PARENTS MARRIED -- this is a little stickier, since one legal parent was a British or Kenyan citizen.

The most important thing to remember is the US Constitution only mentions "natural born citizen" and does not define it. Various US laws have attempted to define it, in terms of parents, parents age, length of time in U.S., etc. SCOTUS has the power to overturn or interpret any of those laws.

Show me where John McCain is definitively shown to be a natural born citizen. That "Sense Of The Senate" thing, Resolution 511, is garbage, with no legal weight whatsoever. It's incoherent, actually, with one major factual error, that of McCain's birthplace in Panama.

LEO IS ON LAN LAMPHERE NOW!
Leo found out that a Judge in lower court in NJ tried to keep his case from going to the SC of NJ and also the SC of US. He filed a suit against a lower NJ court Judge today. The actions of this lower court Judge was to alter Leo’s case motion in such a way that when the US SC called for lower court records, it would appear that Leo did not file things properly in NJ to begin with. That would cause the USSC to deny his case. But because it is already before the USSC Leo says the Conference will go on as far as he knows. He filed his lawsuit against the lower court Judge in NJ today to make sure attention is brought to this Judge’s actions. Leo will be going public now!!!!! He will now be talking to any news agency to bring attention to what happened! Listen NOW on Lan’s show!

Donofrio Alleges Judicial Misconduct, Obstruction of Justice, NJ Appellate Division

Today, Leo Donofrio, also the Plaintiff in Donofrio v. Wells, is separately filing an official allegation of Judicial Misconduct against Appellate Division Judge Jack M. Sabatano.

Today, Leo C. Donofrio filed, with the NJ Supreme Court’s Advisory Committee on Judicial

Conduct, an official allegation of Judicial Misconduct against Appellate Division Judge Jack M. Sabatino with regard to the initial stage of this litigation which was originally filed in the NJ Superior Court, Appellate Division.

The case, having come directly from an appeal to the New Jersey Supreme Court is now before the the United States Supreme Court, “DISTRIBUTED for Conference of December 5, 2008; before all nine Supreme Court Justices.

I am very concerned that if the United States Supreme Court requests the official records of the case from the NJ Appellate Division, a fraudulent case file - not including all relevant documents - will be forwarded to the SCOTUS and thereby the case now pending might be jeopardized.

A copy of the official complaint - by way of a New Jersey Supreme Court generated form - will be uploaded to this blog shortly.
