EL MONTE - Ernie Gutierrez, the mayor of El Monte, was arrested early Tuesday on suspicion of domestic violence and detained for most of the day, police said.
The Los Angeles County District Attorney's Office refused to bring charges against Gutierrez, whose term expires in 2009, El Monte police Chief Ken Weldon said.
Gutierrez did not comment on the incident.
Police did not identify the victim, or indicate how they received the complaint.
Gutierrez was held by police while the District Attorney's Office reviewed the case. He was released when officials determined there was insufficient evidence to charge him.
Gutierrez was arrested about 2:15a.m. and was booked at L.A. County Jail, according to El Monte police Lt. Robert Roach.
"There was not enough evidence to move forward," Weldon said. "We continue to fully support our mayor."
Weldon said he was not aware if drugs or alcohol were involved and declined to discuss the arrest further.
Councilman Art Barrios and councilwomen Emily Ishigaki and Patricia Wallach also declined to comment.
During Tuesday's City Council meeting, Gutierrez was elected on a 3-1-1 vote to represent El Monte on the board of the San Gabriel Basin Water Quality Authority. Barrios abstained and Wallach voted "no."
Gutierrez's personal life came under scrutiny earlier this year when the mayor attended a city event allegedly under the influence of alcohol. With Gutierrez was a woman identified as his girlfriend, Graciela Solano. Gutierrez has denied the allegation.
Gutierrez's wife, Olga, said Tuesday night

..not the El Monte I grew up in
I’ll bet the mayor tried to end it with the GF and the GF called this in on him as an act of revenge.

I used to frequent a C&W nightclub there, Nashville West or such, heard some good old music there more than a few times.
Maybe his attorneys can move for a change of venue to Mexico.
I spent a lot of time at First Baptist El Monte as a child.
Makes me homesick. Tenn. is just not home.
First post in ages. . . .but, I couldn’t pass this one by.
I had business reasons to call Olga on her mobile phone about a year ago. Her voice message made a lasting impression on me. It was, “This is Mrs. Ernie Gutierrez, wife of the mayor of the City of El Monte. I’m extremely busy and don’t have time to call you back. Leave a message.”
The home phone voice message was similar. . .
..was that First Baptist just North of Valley Blvd or First Southern Baptist on Peck Rd?
First Southern Baptist!
..my former church
Really!
My father was pastor at First Baptist Rowland Heights for many years.
he decided to go back to school when Calif. Baptist formed and was meeting at El Monte.
I was nine years old, and met my future husband there. If he had lived only a few more months, we would have been married 50 years tommorow, November 21.
When I saw the picture, the memories really flood back.
Here's a picture of the old Tumbleweed theater across from Crawford's on Garvey:
