I suppose a declared candidate for office would have standing.I'd suggest that standing would be more solid in the Drake case if Allan Keyes, running for President in direct competition with Obama, were a co-Plaintiff.

What people don’t get is that the judge said Berg doesnn’t have standing — no perceived harm to Berg. There was no actual vindication of Obama. This man has more standing because he’s a candidate — perhaps an unknown, but technically, he is in a greater position to open this can of worms.
I am curious if Wiley S. Drake Sr. could split the ticket on the left. If so, then the conservatives blew a big chance by nagging people to shut up about it. If he’s a conservative, perhaps the impact would have been less, but it certainly wouldn’t have harmed McCain.
