If he isn’t the type to sue, then he needs to become that type. Too many “reasonable” people try to handle things in a less litigious manner and are then taken advantage of. Those with no principles subvert the legal system and make it “work for them.” Those who have principles need to learn how to do the same in order to fight back. Maybe that will force a change in the legal system. (I can hope.)

Sue the clerk, the city and the reporter.

Since th ecit ytook quick action against the clerk, the city is likely not going to be found liable. Had the city tried to cover it up, it would be a different story.

Cute, but no worries. Damages received from civil suits are not usually taxable in the first place.

That is usually true of general damages, but not punative damages.

Yes they need to be held accountable, but suing the city is only going to put a greater burden on the taxpayers. They need to be fired immediately then prosecuted

Taxpayers stupid enough to hire democrats - screw 'em (and yes - I am an Ohio resident).

On the other hand, if this clerk performed this crime during the course of her employment, then the city is liable just as any employer is liable for the actions of their employees' work-related activities. They will claim that she acted on her own, but they hired her. One would presume that they vetted her first.

If I had to bet, I’d say there is no reporter. My guess is she was doing this at the request of someone in the Obama campaign.

The “address lookup” excuse makes no sense, for reasons you mention. It would make sense, though, if someone suggested that an admission of being improperly helpful with an address is far superior to being nailed for an illegal criminal records search. She’d be reprimanded but not incarcerated. And, of course, then well-compensated for her loyalty.

That was my first thought..it would be a lot easier to go to the neighborhood and figure ask a few questions to determine which house it was. They wanted a lot more than his address.

It can never be the duty of a public official to commit a crime, so the city will not be held liable if they quickly indict and fire the employee. Chances are the clerk had no criminal record prior to being hired so holding the city responsible after they took quick action just isn't going to happen; and it shouldn't.

The state is in a much different position, especially since the governor issued a statement of support for the director. The state is the party that is really going to pay.

Yep, that is EXACTLY what they were hoping to accomplish, and all those involved in this disgusting violation of Joe's privacy ought to be serving time in the Ohio Department of Corrections for 2 to 5 years minimum.

FYI...I am a TPD retiree. Mike Navarre (Chief) is a good man. If she broke rules and regs she better “lawyer-up” quickly. Mike will let the investigation go forward and then will take the appropriate action. Everyone knows accessing a LEADS computer is a dumb thing to do. If she worked in Investigative Services, the Captain in charge will not tolerate that type of behavior. I worked with most of the upper-echelon of the TPD when they were patrolman. To a man, I think they are honorable and fair. She will find that she is going to be out of work rather quickly.

As an aside, I heard she was checking for 13 ABC. The good thing for Joe, if that was the station involved, it is owned by the network which means immediately after the settlement Joe and his son will be going to Disneyworld all expenses paid....for the rest of their lives.

Since there was a deprivation of a U.S. Constitutional right, the suit could be filed in either state or federal court. Federal court is usually best and the federal court could also deal with the state law claims as well.

Director of Family Services involved in illegal activities - distributing private records. No great surprise here as far as I’m concerned, other than that it wasn’t immediately covered up. Report is the clerk was charged though - even though it’s extremely likely that the director was responsible.
