A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.
Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

Well, your argument of “We The People” is valid and is the one made in all of those cases. However, while SCOTUS decided that the damage wasn’t personal enough to create standing in those tax and other cases, what they were really doing was practical. They don’t want citizens to be able to sue because they would then have to contend with, literally, millions of new lawsuits and the system just can’t handle them. They ruled that the people are protected since their representattives can sue for them.
So who has standing? Pretty much who you said, the Senate, AG., States, the House, etc.

If Berg doesn’t have standing, and We don’t have standing than WHO can challenge his position to run?

He could have been given a diplomatic passport we he became a senator. The question is what was he using before that. Hey we gave loans to illegal citizens so it goes to show how loose our system is.

When Obama is elected and Changes all the things that (evil) Bush and the Republicans have done to “SCREW” this country up, What possibly can he say to the citizens of this country when the next terror attack takes place on our soil, i.e., Radical Islamists blowing up our schools and killing our kids. Those that have standing would probably be the AG, States, Senate, House, DOJ, pretty much any governmental entity.
And it’s really up to the Party to decide if their people are qualified. they are then presumed qualified unless someone proves, in court, otherwise.

I can absolutely see how it may look like I support Obama. But, just trying to analyze objectively. It’s the old, just cause I represented the “bad guy” doesn’t mean I think he was right or didn’t belong in jail.
