The question regarding Barack Obama’s eligibility to run for President based on questions regarding his status as natural born United States citizen has reached the Hawaiian Supreme Court. Illinois journalist and Democrat politician, Andy Martin, has asked the Hawaiian Supreme Court to entertain an emergency writ expediting the release of Senator Barack Obama’s birth records.
For months there has been speculation about Barack’s birth status among other issues associated with his birth certificate. This has been helped along by the campaign’s reluctance to produce uncontestable records of the Senators birth and status as a natural born citizen of the United States. When the Obama campaign did release a scan of Obama’s birth certificate its noticeable lack of an embossed seal among other inconsistencies with proper Hawaiian birth certificates simply fueled the speculation of critics.
The Hawaiian Supreme Court now has the opportunity to answer these questions once and for all.
There has been no shortage of theater surrounding Andy Martin’s actions at the Supreme Court. In the same week that the request was made by Mr. Martin, Associate Justice Steven Levinson announced his surprise retirement from state’s highest court. While he explained his actions by saying that his “batteries needed recharging”, court watchers are theorizing on the significance of the move and what it may be telegraphing in regards to the Martin request to open Barack’s birth records. Justice Levinson will be serving until the end of the year.
Presidential candidate Barack Obama has also indirectly interjected himself into the situation. During the same week that Mr. Martin’s request was made to the Hawaiian Supreme court, Barack is suspending his campaign for a few days in order to visit his sick grandmother in Hawaii. Unnamed sources claim that he is bringing along a team of lawyers on this visit to an ailing relative. The Obama campaign has not yet answered our query regarding whether Barack has brought a legal team with him to Hawaii.
A decision by the Hawaiian Supreme Court is expected before the election. We will report on that decision when the high court makes its ruling.
You are right, but the effort as I understood it was to obtain this information in time for it to be presented to the electorate BEFORE the election.

If I understand it correctly, there is/was an action pending in the First Circuit Court of Hawaii, with Judge Abaye. Abaye has apparently scheduled a hearing on 11/7/2008, requiring Martin to appear in person.
Martin appealed to the Supreme Court for an expedited hearing, which was denied. But, the order also appears to turn down his original demand (for the birth certificate) as well. I don't know if that renders the Circuit Court hearing (on 11/7/2008) moot, but I suspect it would strongly influence Abaye's decision. :-)
I do find it interesting that the decision doesn't address the original issue at all. It only (effectively) says: a "writ of mandamus" is an extraordinary effort that should only be used to compel action that is mandated by law. But, the law grants the Department of Health discretion, and we (the court) aren't going to override them.
I'm not familiar with this state's law, but it's clear the courts will continue to stone-wall this. Maybe there's a procedure for appeal to the Dept. of Health, but that's not likely to go anywhere, either.

I get the feeling that Obama is trying to run out the clock. Presuming that he is hiding something, he probably figures that he will be negotiating from a much stronger position if he wins the election.
However, I expect this issue will not go away if he wins the election. The problem is that the court system will continue to stone-wall, claiming that no single person has standing to challenge his eligibility.
It's probably going to come down to when the true election (the meeting of the electors) is held. At that time, perhaps one of the electors representing McCain will make the challenge. And that will create turmoil that will make the 2000 election look tame.
The Supreme Court will have to decide what a natural-born citizen is, and take Obama's history of citizenship (US, Kenyan, Indonesian) into account. And it will probably come down to a 5-4 vote, with Stevens casting the deciding vote. Either outcome will fracture this nation, possibly the worst since the Civil War. Nobody wins, everyone loses.
The easiest way to avoid this possible outcome is for McCain to win.
The Constitution goes to great length to ensure that only a natural born US citizen can be President. It’s amazing that there is no formal procedure to check on a candidate’s citizenship before he is sworn in as President. We are probably going to need an Act of Congress to compel an agency to define a procedure. Meanwhile, any challenge to a candidate can be easily thwarted, as we are witnessing now.

It Matters. Constitutionally, when he was born in 1961, his mother would have had to live in the USofA for 5 years AFTER her 16th birthday for her baby to be a NATURAL BORN US Citizen. She was 18 when he was born. She didn’t qualify, he is ONLY a US Citizen IF he was born in the USofA and IF he reapplied for US Citizenship through NATURALIZATION because he was ADOPTED by Lolo Soetoro and given Indonesian Citizenship so that he could attend school in Jakarta, Indonesia (they only allow Indonesian Citizens to attend school).
So Barry’s LEGAL FATHER is not Obama Senior, it’s Lolo Soetoro. Barry’s LEGAL NAME is Barry Soetoro. His birth father is not his legal father. Yet he wrote (or Ayers wrote for him) a book about his “sperm donor” father.
When Lolo adopted Barry, ANY records in Hawai’i were SEALED. He lost his US Citizenship. He MIGHT have been able to convince the Courts that he wanted US Citizenship back IF HE WAS BORN IN THE USofA after the age of 18 had he filed with the US Courts (Hawai’i, probably). BUT, at the age of 19/20, he applied for a Passport to go to Pakistan using his Indonesian Birth Certificate. By THAT ACT, he declared himself an Indonesian Citizen and NOT a US Citizen.
How do we know he used his Indonesian BC? Pakistan, in 1981 was under Martial Law and NO US Citizens were allowed to visit. Barry’s books clearly state he visited unknown persons and his college roommates (who were Muslim) during his visit to Pakistan in 1981 during his “round the world tour.”
There is documentation from Barry’s Kenyan Grandmother that she and another female relative were in the hospital in Kenya when Barry was born. Jerome Corsi was deported by Kenya because he was investigating Barry’s Kenyan birth.

John McCain was born to two US citizens on a US Naval Base in Panama when Panama was under US Control. THAT designates him a Naturalized US Citizen.
I doubt if he has a US passport. US government officials don’t need them for ‘official’ business. The Indonesian one he had was probably destroyed. So, if he were asked to produce one, he couldn’t. Maybe he could get China to make him one.

Yes but this element of the constitution is plain. We know the age of his mother. It will be hard for them to present evidence that is a lie now.
From what I've read so far, neither of his parents met the requirements. Which means, neither does he.
Which means his candidacy is no more legitimate than my Russian immigrant Father's would be should he run. I was born in Minneapolis and have a CLB from St. Mary's. It's a certified copy that is a matter of public record.
Obama could undercut this claim easily. He hasn't. This speaks volumes...
