I believe it is Berg’s arguement that as a Democrat, his candidate is not qualified to hold office. Therefore, by nominating Obama, the DNC has left him without a valid candidate. Thus disenfranchising him and the Democratic voters. If I were the judge,I would agree.

There must be some merit to the case if there are so many groups entering the litigation on Obama’s side.

If an individual is sued and doesn't respond, does the plaintiff not win by default? Maybe if the media won't cover this it is time to start asking the question why no answer was filed in every comment we leave on other websites.

No matter how this turns out- it is surprising to me that although the Constitution has requirements for the office of President; there seems to be no system in place to make sure a candidate meets those requirements.

Here is some text from the 20th amendment to the constitution:
If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.This text suggests that the qualification to be President is applied after the election, not before. It also suggests that you can elect someone who isn't qualified, and if you do the VP becomes president.
Now, I think we could argue that "qualified" here is not regarding the legal requirements for the office, but means "qualified" by getting enough electors, or by being chosen by the house if there aren't a majority of electoral votes. But it seems to be more general to me.
The key though is that there is this lawsuit, and it hasn't been dismissed. It means that we can all bring up this lawsuit, and note that if you vote for Obama, you might well end up with Biden as President since there is a good chance Obama might be found "not qualified" after the election.
In other words, we can use it to stir up doubts about WHO you are electing. A person who might throw his vote away for the "black guy" might think twice if he realises there's a good chance he's voting for Biden over McCain.
The FEC simply does not want to deal with the fallout that may come from the COLB.

Pakistan was on the banned travel list for US Citizens at the time. Since Obama was just a graduate from Occidental College, travelling with a friend, and not a diplomat in U.S. service, how would the United States issue a passport to a country on their banned list? HMMMM?
However, Indonesia and Pakistan did not have hostilities with each other at that time. A Muslim with an Indonesian passport could enter.
Barack Obama must have used an Indonesian passport, which is granted ONLY to citizens in Indonesia and MUST be renewed every 3 years. That means Obama was still an Indonesian citizen, during his travel, if such passport was used.
Neither Kenya, nor Indonesia recognized dual citizenship, subsequently, the U.S. did not recognize dual citizenship with other countries that did not recognize dual citizenship.
Did the US issue a passport to go into Pakistan, in violation of the restriction, AND the Pakistani “Border Officers” violated their own laws and welcomed a U.S. citizen who professed to be a Christian? Or did he use an Indonesian Passport to go to Pakistan confirming that he knew that he was an Indonesian citizen?
If the INS has records, or if he can show that he renounced his alien citizenship while pledging an oath of allegiance to the United States, then he is not an illegal alien.
Don’t simply take my word for it. Double check his professed words of his travels, and the U.S. and Pakistani passport & travel laws of 1981
