Why Is DoJ Ignoring Election Fraud?
Heritage Foundation ^ | 10/21/08 | Conn Carroll

Posted on 10/21/2008 12:44:03 PM PDT by paltz

This past Friday the Supreme Court issued an order setting aside a Sixth Circuit Court of Appeals order forcing Ohio’s secretary of state Jennifer Brunner to verify the accuracy of the information provided on applications for voter registration. The Ohio Republican Party had sued to force Brunner to comply with the 2002 Help America Vote Act (HAVA) after widespread reports of voter registration fraud. The Court expressed no opinion on whether Brunner was following HAVA — it threw the case out on the grounds that the Republican party didn’t have the right to sue to force compliance.

As Heritage fellow Hans von Spakovsky notes, he made the exact same argument the Court just made when he worked for the Department of Justice in 2004. Except then it was Democrats asserting that HAVA included a private right of action and Democrats later attacked him for that very position when he was appointed to the Federal Election Commission. Leaving the left’s blatant hypocrisy aside, who can enforce state compliance with HAVA to prevent election fraud? Only the Department of Justice.

We have no idea why DoJ has declined to investigate ACORN’s blatant election fraud in Ohio (and across the country), but this report from The Examiner’s Quin Hillyer might just be relevant: “In all, DOJ lawyers and staff in the metro area have donated at least $150,000 to Obama. No wonder they seem more interested in prosecuting those who warn against vote fraud than enforcing vote-fraud laws.”

Fraud yes, RICO no. It takes more than crossing state lines to commit fraud to be guilty of RICO.

From where I sit, most of the USSC turns Left during their tenure. Name me one Justice that has veered Right after being appointed by a Dem.

“They set it aside not because of the issue ...”

I didn’t like that when it happened, but I understood it. Then I wondered why someone “with standing” didn’t take the issue to SCOTUS. Maybe it’ll happen...

That was my thought too. Why the GOP started this instead of an individual.

“There are approximately 14 states conducting investigations right now. Obama is demanding the probes stop and a Special Prosecutor be named. ACORN is going to be charged under Ohio’s RICO statutes.”

Only a small-taste of what we’ll endure under the Barack Hussein Ceausescu regime.

DoJ lawyers want to become federal judges.

To become federal judges they kiss the posteriors of the democrats. (majority or minority)

it is a government job.

remember most judges if not all, come from teh DoJ ranks.

Old boys club.

If they demand others be held accountable for fraud, they might have to clean house, too.

Bush only fought terrorism and appointed 2 scotus. A good president would fight islamofascism, cut government waste, kick out clintonistas in the CIA state dept and DOJ, and fight domestic fraud and illegal immigration.

Nothing is being done because Bush is a anti-American Liberal Globalist

Same reason we dont enforce our border and immigration laws....same reason why we are spending trillions to build hi-ways thru Mexico for Commie China (instead of using US ship ports)

And....do not ever forget that Bush and McCain still hold each other in acrimony. Never forget

Unfortunately, there doesnt seem to be too many real conservatives anymore.

Too true.

But we are out here.

"Why Is DoJ Ignoring Election Fraud?"

Cobra is correct.

Because that would mean the DOJ would have to address the fact that we have upwards of 40 million people illegally in this country, and the fact that a large percentage of these millions routinely commit identification fraud among other crimes.

This country's legal justice system is upside down.

Just call it the legal system. Justice became totally irrelevant in America a long time ago, when Lon Horiuchi openly murdered an innocent woman for Bush 41 and walked away scot free.

That fit the R.I.C.O. statute perfectly.

Sorry. The goobermint's quota of RICO lawyers are fully occupied harassing and smearing the characters of prolife demonstrators who have the audacity to pray on the sidewalk.

Remember about half of USSC judges flip from what everybody thought they’d be after hey get there

I have no recollection of a liberal justice ever becoming more conservative. It is always the other way around.

the whiners on the left who use the chant are just being spoiled losers.

No. They have been fuelled and deliberately maintained in a state of hateful rage by an insurgent faction which seized control of the 'rat party. Mere spoiled losers would have gotten over it by now.

But still, a lot of the problems the Bush presidency had started in Nov of 2000 when half the country was given an excuse to consider him illegitimate

They did use the excuse but would have found another one if need be. The leftwing 'rat hate fest has been a necessary foundation for the Obama campaign, which relies on ignorant masses willing to elect anybody just so long as he promises to defeat the hated republicans. And yes, the wellbeing of the nation be damned.

"Why Is DoJ Ignoring Election Fraud?"

Because this administration has always been AWOL when it has come to defending themselves.
