This past Friday the Supreme Court issued an order setting aside a Sixth Circuit Court of Appeals order forcing Ohio’s secretary of state Jennifer Brunner to verify the accuracy of the information provided on applications for voter registration. The Ohio Republican Party had sued to force Brunner to comply with the 2002 Help America Vote Act (HAVA) after widespread reports of voter registration fraud. The Court expressed no opinion on whether Brunner was following HAVA — it threw the case out on the grounds that the Republican party didn’t have the right to sue to force compliance.

As Heritage fellow Hans von Spakovsky notes, he made the exact same argument the Court just made when he worked for the Department of Justice in 2004. Except then it was Democrats asserting that HAVA included a private right of action and Democrats later attacked him for that very position when he was appointed to the Federal Election Commission. Leaving the left’s blatant hypocrisy aside, who can enforce state compliance with HAVA to prevent election fraud? Only the Department of Justice.

We have no idea why DoJ has declined to investigate ACORN’s blatant election fraud in Ohio (and across the country), but this report from The Examiner’s Quin Hillyer might just be relevant: “In all, DOJ lawyers and staff in the metro area have donated at least $150,000 to Obama. No wonder they seem more interested in prosecuting those who warn against vote fraud than enforcing vote-fraud laws.”

For the same reason we don't enforce immigration laws. And put border patrol agents in jail for doing their jobs.

This country's legal justice system is upside down.

They set it aside not because of the issue (voter fraud) but rather saying that the GOP is not a party who is harmed. Individual voters are harmed, the GOP isn't a registered voter.

I wouldn't want the USSC to hear it if it is flawed. Nor would I what the USSC to hear it and amend it to give a ruling, right or wrong.

What precedent would that set for lower courts? Could could begin issuing any decision related to the case or not.

Because

• it's political and therefore a hot potato
• it's a potential career ender no matter which side is favored by the resolution
• bureaucrats who get involved probably won't get any cover from their superiors, especially if the winds blow the wrong way, which they always do

If they keep on ignoring it, the left is going to keep on pushing the envelope. Eventually the voting public will lose faith in the system. Then it's... see my tagline.

There are approximately 14 states conducting investigations right now. Obama is demanding the probes stop and a Special Prosecutor be named. ACORN is going to be charged under Ohio's RICO statutes.

When will the DOJ get involved, you must look to each region of US Prosecutors. I don't know if they are idle, maybe just not talking to the Press.

The question is, “Why is George W. Bush, the chief law enforcement officer, ignoring election fraud?”

Phrase the question the correct way and it has more meaning.

Because after 8 years of hearing “selected not elected” there’s no way the Bush White House is going to do ANYTHING that even HINTS at using legal maneuvers to decide this election.

As I understand it, it was not the full court's decision.

They should go after those college students, some of them Rhodes Scholars, in Franklin County Ohio. Ron O'brien, Franklin County Prosecutor, has already started making excuses for them.

The should be indicted under the R.I.C.O. statute. There were more than 2 of them and they crossed state lines to commit voter fraud. That fit the R.I.C.O. statute perfectly.

8 years ago (2000) the USSC opined in Bush vs Gore that you do not have a right to vote in a Federal election ... until "The individual citizen has no federal constitutional right to vote for electors for the President of the United States unless and until the state legislature chooses a statewide election as the means to implement its power to appoint members of the Electoral College." (Bush vs Gore, IIB).

Maybe the DOJ has no jurisdiction ... yet.

One reason may be that we haven't had an election yet.  We've had registration fraud, but not election fraud.

Of course if DOJ lawyers and staff in the metro area donated $300,000 to McCain it would completely reverse the meaning of the above statement.  I'll just have to trust what they are leading me to believe and note that it is a very interesting paragraph.  The article provided at the link for The Examiner is interesting too.

Bush's Fault.

Bush never cleared house at the Justice Department when he became president. Most of the Clinton political appointees were not fired and their nepotistic Democratic hires were never replaced. The very first thing Clinton did when he came into office was replace all the Republicans. Bush did not.

The CIA leadership was not replaced either and was responsible for the 'you can take it to the bank' data on WMD.
