8 years ago (2000) the USSC opined in Bush vs Gore that you do not have a right to vote in a Federal election ... until "The individual citizen has no federal constitutional right to vote for electors for the President of the United States unless and until the state legislature chooses a statewide election as the means to implement its power to appoint members of the Electoral College." (Bush vs Gore, IIB).

Maybe the DOJ has no jurisdiction ... yet.

There’s that possibility too. But really I can’t think of many worse ways for the Bush presidency to end than to setup their successor for the same “selected not elected” chant. Yes in both 2000 and 2004, and more than likely if such a thing happened in 2008, the right thing happened, the whiners on the left who use the chant are just being spoiled losers. But still, a lot of the problems the Bush presidency had started in Nov of 2000 when half the country was given an excuse to consider him illegitimate. 8 more years of that could be as bad for the country as the worst imaginings about Obama.
