I received a phone call from Phil J. Berg a few minutes ago. He informed me that a rumor is circulating on the Internet that the Court has ruled on the Motion to Dismiss filed by Senator Obama and the Democratic National Committee in the Berg v. Obama case. Some of the visitors to this website have posted comments claiming the Court has ruled. The comments on this site were written by visitors to the site.
On Mr. Berg's behalf, I am posting this to state clearly the Court has not yet ruled on the Motion to Dismiss in Berg v. Obama.
Here's the status:
1. Last week Senator Obama and the Democratic National Committee filed a Motion to Dismiss the Berg v. Obama lawsuit. 2. On Monday, Mr. Berg filed an answer requesting that the suit not be dismissed and that the Court order production of documents proving Senator Obama's consitutional qualifications to serve as President of The United States. 3. As of 1 AM EST today, October 2nd, 2008, the Court has not ruled on the Motion for Dismissal in Berg v. Obama.

This could be an issue that Palin should push. She could say something like "Barak Obama has been sued by xxx on the grounds that he's not an American citizen because he won't produce a birth certificate. Now this may be a silly lawsuit, but there's one way to prove it...here's my birth certificate Mr. Obama....where's yours?
I can’t believe there isn’t a state where Obama or anyone has to prove their eligibility to run.
We only need one state that could be sued to prove that he is eligible.
She’s already catching hell for saying Obama pals around with terrorists (Ayers) which is demonstrably provable. If she were to challenge his citizenship can you imagine the torrent of abuse she would receive? Not worth it.
One doesn’t have to be ‘eligible’ to run for president, only to serve as president. There’s nothing illegal here.
I think the least the court will do is say - wait until, and if, he’s elected.
As a side issue, his refusal to produce said documents shows that he is a terrible leader. A decent leader might have let this go on for a bit, but then produced the documents (a bit of rope-adope).
But this has gone well past that point. If he produces the documents now he has shown a willingness to let little problems grow into very big problems by ignoring them. That is very poor judgement.
Will he also show such poor judgement on the international stage, where such incompetence can have much more far-reaching implications? So far, I have seen nothing to indicate that he won’t do exactly the same thing in diplomacy.
I’m proud of FR for repeatedly squelching threads making the false claims.

Is there one or do you have to call the courts there?
Was it ever posted in a reputable newspaper?
I expect him to slither out of it and don't expect it to go anywhere. If it's true, the public has a right to know, not that many care.

but no he has a lawyer from CAIR(law wing of terrorists sympathizers) and now the DNC is going to court to stop this then all I can think is there something incriminating to obama.
why hasn;t some law enforcement looked into this surely there has to be proof that one has to be an American before they run for this position
I have always believed nothing to hide then shot it, he goes to all this to stop it then there is something to hide
I only hope Berg does not give in and I hope the GOP gets on live cameras, not recorded so the media edit it and state where is obama’s B/C and why has he gone to court to stop this.

Too dangerous a precedent. . .while there will pobably by ‘riots’ whether he ‘wins’ OR loses (either reason will do) - this unfolding would move this country to a riotious free-fall. Besides; there is only one reason to be on ballot and that is the assumption that you can/will win. So, seems ‘intent’ is a factor that cannot be considered.
