Lawmaker’s son hires a lawyer in Palin e-mail case

David Kernell, the young Memphis man at the center of a controversy over Alaska Gov. Sarah Palin’s personal e-mail, has hired a Knoxville attorney to help him deal with the issue, his father, state Rep. Mike Kernell, said today.

“He’s hired an attorney,” Mike Kernell said by phone this afternoon. Kernell confirmed that the lawyer is Wade V. Davies of Knoxville.

Shall we assume the DNC’s paying? The FBI needs to pull the kids computer and see how many other Republican’s he’s damaged.

Think again! This is real bad PR for Yahoo. You can bet they will prosecute! By refusing to do so will tell its millions of email users that they don't care if their e-mail gets compromised or not. This violated not only their user agreement rules, but having the Secret Service and a federal law on the books doesn't give this sh!tbag punk any wiggle room. His best bet is to try to prove through cyber forensics that he was not the hacker. Again damn near impossible to do since they were able to track it back right to him.

I think they likely had a choice of bringing the charges either where the violation took place or where the Yahoo servers are located. TN will provide a pretty friendly jury pool for the grand jury to be seated.

The prosecutor has his own show in grand jury. Only the witnesses are allowed in and their lawyer’s are not allowed to join them. The witness may step outside to consult with the lawyer if they wish. I would be shocked if anything other than a “true bill” was returned.

Trying the actual case will be trickier. There probably are not that many federal prosecutors with experience in “cyber” cases.

What I hope is that they make an example out of him and raise the awareness of the penalties for this sort of cybercrime and the ease with which the perp was tracked down.

But on the other hand, he’s a young stupid kid with a democrat father for a role model and fortunately no harm was done. If anything he helped McCain.

Therefore, I hope they throw the book at him with tough sentences, let it sink in to that rat brain, that Palin’s not corrupt, David Kerner is corrupt. Then I hope Sarah Palin requests they reduce his sentence and they let him off reasonably easy with community service.

Good. Now maybe a deal will be cut to give the kid immunity from a federal prison sentence in exchange for naming names in the Obama campaign. I don’t know if the results of a deal would leak out but McCain needs as many examples of illegal activity as he can find to tie back directly to Obama. Then Schmidt will be able to produce some real red meat ads instead of that “is he ready to lead?” fluff.

Do you think it will hurt him that when the FBI arrived he and his fellow partygoers ran? Judge Napolitano offered that tidbit this afternoon on Fox.
