Defense attorneys are bristling at federal prosecutors' plan to compare Hamas terrorists, who the government contends were financed by the Holy Land Foundation, and Osama bin Laden's al-Qaeda.
Prosecutors hope to have Georgetown University professor Bruce Hoffman testify that most major terrorist groups use charity organizations in the same way Holy Land is charged with supporting Hamas to not only raise funds but also to win popular support. They say showing how the two networks mirror each other is relevant.
But defense attorneys say prosecutors just want to scare jurors by introducing the world's No. 1 terrorist into the trial.
Judge to rule later
District Judge Jorge Solis said during a Thursday hearing that he won't determine whether Dr. Hoffman will testify until later in the trial, but noted, "I'm troubled with getting into anything about bin Laden."
Five organizers for Holy Land are accused of funneling more than $12 million to the Palestinian group Hamas, which was designated a terrorist organization by the U.S. in 1995. Last year's first trial ended in a hung jury. Opening statements in the retrial are set for today.
During jury selection last week, jurors were repeatedly told that the Holy Land case has nothing to do with Mr. bin Laden or the Sept. 11 terrorist attacks on the New York World Trade Center and the Pentagon.
