EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.
The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.
No reason was given for the Wednesday's denial.
Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.
Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

Technically it's shoot to stop the threat not shoot to kill. Shooting to stop does not nessesarily include killing the suspect nor does it preclude it.
Sprint through an obstacle carrying a shotgun. Wrestle with a felon for you life. Then add the shock and trauma of seeing said felon try to shoot you. Then try to defend yourself by shooting in a condition you 've never shot in before and it becomes real easy to miss. Compean's story is plausible and most likely true. The fact that he did a magazine exchange lends even more credence to the fact that he feared for his life.

Minus any deflection the bullet would continue along the path the person was running. The left buttock would have an entry would and the bullet would travers in a relatively straight line.

You know what is truly sad about all this? Ramos and Compean are sitting in solitary confinement while their erstwhile defenders are splitting hairs over the type of report they filed (or whether they filed one at all).
You are certainly obsessed by the topic you know is a red herring. You accuse others of refusing to drop it when you are the one that continuously brings up your idee fixe. Be that as it may, what do you want the supporters of Ramos and Compean to do? Storm the prison with pitchforks and torches?

Well, apart from the facts that Johnny Sutton is not Mike Nifong, and the 5th Circuit is not the 9th Circuit, you have a point.
That’s why I’ve made the argument that they are not conservatives but dangerous extremists with an agenda who wrap their philosophy up in patriotic sounding themes to provide them cover and dupe the ignorant.
No conservative would approve of extra-judicial executions.
No conservative would approve suspending basic civil rights like innocent until proven guilty and a right to a trial.
No conservative would approve of LEO’s abusing their power under the color of authority (check Ruby Ridge and Waco).
No conservative would trash the reputations of career border patrol agents who unwillingly were pulled into a bad shoot by calling them liars and corrupt.
No conservative would smear the reputations of the entire DHS and DOJ chain of command from the President down to a prosecutors, judges and juries to excuse LEO’s who attempt a bad cover up of bad actions.
