Technically it's shoot to stop the threat not shoot to kill. Shooting to stop does not nessesarily include killing the suspect nor does it preclude it.
Shooting “to stop the threat” is a kind way of saying shooting to kill. If you do so and the target doesn't die, it's incidental.
