Border Agents Who Shot Smuggler Denied Appeal (Ramos & Compean)

EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.

The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.

No reason was given for the Wednesday's denial.

Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.

Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

Maybe instead of "zero," I should have said "undefined?" I'll grant you that much, but as I've been maintaining all along, Ramos and Compean are sitting in prison because the meat of the convictions on the charges were upheld.

Meanwhile you (the legal expert), the English expert, and the policy expert are reduced to patting yourselves on the back for picking-up breadcrumbs.

Do you use Biden as your model? I mentioned Gopher bashing a while back, you might try something a little more original.

Yrigoyen and Mendez were on top of the levee. Had Compean picked up any shell casings close to the top they would have seen that action. Plus the magazine that Compean dropped did not fly anywhere but straight down and unless Compean is the size of a circus midget he would have been seen picking that up by everyone. Or are you contending that the magazine is still on the levee since no one mentioned that he picked that up?

Your attempts are laughable, but the question to you which you have yet to answer is "who is the person that testified that Compean told him that he thought Ramos hit Davila?"

You haven't answered that. Whack-a-mole? Seems like you are the one receiving the whacks. Put up the testimony to back your statement ....Another BP Agent testified that Compean told him after the shooting that he thought Ramos had hit the guy.

That “not found guilty” (therefore “not guilty”) versus “found not guilty” (therefore “not guilty”) diversion was funny for a short while.

You are a riot, expressing pride in your lack of knowledge of modifiers and their use in the English language. Again NOT FOUND GUILTY is not the same as FOUND NOT GUILTY. In the the one case no finding is made. In the other case a finding is made. Your illiteracy is your hindrance.

Do you remember some guy going on and on (and on and on and on and on) about Ramos and Compean not being required to file a written report, as if it was dispositive evidence that policy was not violated?

Well, you certainly don't remember that it was not Ajnin [NOTE TO the rude one, the "NOT" modifies the noun "Ajnin"] who introduced the subject of reporting. It was introduced in post 40 with this statement First, both of them knew that it was their responsibility to file an incident report and furnish their supervisor with it. Not the other way around.

mjaneangels@aolcom responded to that and rudeboy, the munificent swillmerchant, responded with this gem ...Proof or STFU.

Then did Ajnin enter into the discussion about the reports.

And rudeone, your predicted tap dance about filing and verbal isn't going anywhere.

I did not mention this, but I will now.

Compean testified the OAD ran away not on a straight line, but at a 45 degree angle TO THE LEFT. That means not only was Comp partially down the side but he was turnd as well at a 45

You are mixing two testimonies. Compean did testify to the 45 degree angle to the left, but he also testified that he was on his knees at the bottom of the south side of the levee. Juarez testified that he saw Compean at the top. You can't pick and choose without some other justification. Juarez did not mention any angle.

Eventually. Ramos testified they arrived as he topped the levee and walked toward his truck. That would be after Ramos and Compean picked up all their shell casings.

Standing three feet down from the edge and having shell casings exit 5'-10' feet while shooting at an angle of 45 degrees would deposit those casings well down, maybe halfway, of the levee. Kareem Abdul Jabbar could pick up those casings and not be seen.

A well trained sharpshooter might leave brass at the scene of a shoot but they would never leave their magazines. Compean picked it up as he headed down to Ramos after Ramos shot "Scarface" in the back.

The whole Davila episode screams for deeper investigation. How did a van which was sold to someone in Mexico get to the spot where Davila entered it? Where did the driver that left it at the spot go to? Why could he have not just driven the van filled with the drugs to the original destination. What quality did Davila possess that the aforementioned driver not possess? Davila said someone was to direct him where to go using another car. But what is interesting is that Jess Harris(or the Fabens st as it is called in town) goes directly to the freeway and intersects it at about mile marker 49. Fabens st is the closest path to the freeway from where the van was first spotted. Davila was no amateur.

You said this Another BP Agent testified that Compean told him after the shooting that he thought Ramos had hit the guy.

That is absolutely clear that you did not mean Compean. And in any case the testimonies of the two individuals makes it clear that Compean was mistaken on this point.

Kareem Abdul Jabbar could pick up those casings and not be seen.

Kareem Abdul Jabbar would have been seen by someone on top of the levee much easier than a midget would have been seen.

And you don't get to mix testimonies. But you still haven't answered how Compean could have picked up the magazine from the top of the levee and not been seen. Plus your geometry would certainly make the casing that Vasquez allegedly picked up from the north side of the levee a "magic" casing since the levee road itself is 15 feet wide.

From what I understand Davila was investigated “deeper”...by that evil mastermind anti American Sutton...and is now cooling his heels in an American Federal Penitentiary for about a decade.
