Patrol fires 12 troopers in cheating case Thursday, September 11, 2008 3:21 AM

FROM THE (CANTON) REPOSITORY CANTON -- Twelve officers accused of cheating on a certification test for a device used to gather evidence against intoxicated drivers have been fired from the State Highway Patrol.

Patrol spokesman Lt. Tony Bradshaw said it's the first time in the law-enforcement agency's 75-year history that so many officers have been let go at once.

The patrol said the three sergeants and eight troopers from the Canton post and one Wooster trooper cheated on a certification exam for administering breath tests to determine the level of alcohol in suspected drunken drivers.

The troopers were placed on paid leave last month, and the patrol recommended their dismissal. They were fired Monday when Ohio Public Safety Director Henry Guzman agreed. The issue was whether a trooper supplied others with test answers.

Bradshaw said the officers may appeal to an arbitrator.

Herschel Sigall, the general counsel at the Ohio State Troopers Association, insisted that some of those fired never cheated on the test and said that he expects most of the troopers to file grievances.

Some drunken driving cases involving the fired officers could be reopened.

How hard can the test be? How do you "cheat" on a breathalyzer exam?

I would like to see some details.

While the operator's certifications are not especially difficult, they do involve a working knowledge of the machine and spectrochemical analysis to insure the device has been operated correctly and that a defense attorney can find no room to impeach the procedures of an officer's administration of a test to a suspected drunk driver.

The cheating is being able to ADMINISTER the test. They were too inexperienced to properly handle the machine.

If it isn’t calibrated properly, you can have false positives. But go after the drivers by all means. It means thousands of dollars in fines.

These guys were fired for jeopardizing the huge income the government gets from DUI fines. If they had let a bunch or real criminals get off, nothing would have been said.
