Wife, kids in home as resident kills intruder

A North Sacramento man shot and killed an armed intruder early Tuesday as his pregnant wife and children awoke in terror from the attack. The man, whom police did not identify, told police that two men had tried to break into his home just after midnight in the 800 block of Carmelita Avenue off Rio Linda Boulevard.

The resident, who had no telephone, pleaded with neighbors to alert police after the shooting, neighbors said. A neighbor who provided refuge for the resident and his family after the attack recounted what the man told him. The resident heard scuffling and banging on his door, said Robert Jerome, the neighbor. Looking through a peephole, the resident saw a man holding a .22 caliber pump-action rifle, Jerome said. By the time the man got his shotgun, the intruders had partially opened the door, the resident told Jerome and police.

The resident fired once through the gap in the doorway, striking a 19-year-old Sacramento man, police said. The other suspect or suspects fled, but the 19-year-old, dropped the gun from his hand, staggered into the cul de sac before collapsing dead, the resident told the neighbor and police.

More details on this shooting. Sound totally justified.

There are some benefits in using a Shotgun over a pistol, much more room for error.

Sure does, unfortunately this happened in California where we do not have the right to bare arms.

That man saved his family’s life, and saved the taxpayers a lot of money trying to rehabilitate this “poor misguided youth”.

In Kalifornia there is no such thing as a justified shooting - unless you are a cop. That said they at least softened the statute that required you to flee your own home if it was being invaded. This guy will probably be charged pending investigation. They will discover his guns were not legally obtained and charge him with something like “illegal possession” slap him on the wrist etc. Cannot have citizens defending their families in their own residence. Might start a trend.

Kinetic energy on target, too.

Just curious what others think:

To be perfectly safe (legally), would this shooter have been better off waiting a few more seconds until the intruders were all the way in the front door?

I know that’s a risky thing to do from an operational point of view. But in today’s political climate, should we be thinking of the legalities if we are ever in this unfortunate position?

Again, I’m not criticizing what this man did. He acted valiantly. I’m just curious what others think about this.

If that's true, why wasn't this shooter arrested? I hope you are exaggerating.

You should consult a lawyer, but in California, probably.

In Texas, no difference whether he’s inside or outside.

He may still be arrested when the DA reviews the case. Yes I was exaggeerating some but for the most part for many years it was illegal to defend your castle in Kalifornia.

Plus it is less likely that errant shot will pass thru a wall and create “collateral damage”.

In southwest Atlanta yesterday a teenage boy was struck by a bullet that was fired from an apartment two floors above him.

Not at that range, unless you mean that the damage is much greater.

Durn...shotgun vs .22 rifle in close quarters. Pretty bad odds for the perp with the .22.

wow, so thats what weve come to eh ???

how about city tax, state sales tax, fcc fees, algores fee, long distance provider fee, 911 fee, school tax heheh,

maybe ??? he chose to buy milk for the kids with that 20-50 bucks a month...

you would prolly bitch and moan if the family signed up for the 'free fed phone assistance program'...which he no doubt probably do now...

then, after the bgs take a pair of side cutters to the line, will you say 'how in the hell in this day and age does somebody not have an unlimited cell account' ???...

Id rather say "Thank You Sir" for takin out the trash and pray that God delivers his family from the tyranny that may befall them from the very polidiots that breed this home invading scum...

/rant...

I actually know people who overlap our social circle who don’t have a landline telephone. They have cell phones, or VOIP on their Internet connection. What happens most of the time is that they leave the cell phone around the house, or let the battery go dead. Strangely enough, the only people I know like this are also heavily armed and only call LEOs and EMTs after the shooting has stopped.
