CBS Complains, YouTube Takes Down McCain Ad Using Couric

A John McCain campaign Web ad that used a clip of CBS News anchor Katie Couric to chastise Democratic candidate Barack Obama has been pulled by YouTube, because of CBS' copyright complaints.

Campaign officials did not immediately return a request for comment, but the YouTube page that had contained the ad now has a message saying, "The video is no longer available due to a copyright claim by CBS Interactive."...

Gee, such use would be covered by Fair Use, and also by the first amendment. Political speech deserves special protections from such claims of copyright, by the intent of the first. That’s why slander and libel rules are very relaxed for political speech.

From the U.S. Copyright office:

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered “fair,” such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes; (my emphasis added)

2. the nature of the copyrighted work;

3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

4. the effect of the use upon the potential market for or value of the copyrighted work.

I would argue that McCain's campaign is nonprofit, and the purpose of the ad was for educational purposes of the masses.

He really ought to go on the offensive about copyright law abuse — it keeps being used as a bludgeon on him, and he just sucks it up.
