The very issue at hand is whether foreigners who are trying to murder Americans are protected by the US Constitution.

The Constitution nowhere says that they are and up until a few years ago, no American jurist ever suggested that they were.

To claim that Yemenis in Cuba have the same legal rights as American citizens in America is to mock the Constitution.

The Founding Fathers of the United States of America DID NOT WRITE the U.S. Constitution for a bunch of Islamofascists killing Americans and trying to destroy OUR country! If Obammie had spent more time in the United States and less time in Indonesia, who would know that. The SCOTUS “mocked” the Constitution when they gave constitutional rights to maggots who have never even been to this country. Stuff it Obammie!!!

The US Constitution, Article I, Section 9 (I mistakenly identified this as 8 in a previous reply) states:

The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.

Congress gave President Bush that power in the legislation they passed authorizing him to fight the War on Terror. So it's entirely Constitutional.

The Constitution allows the writ of habeas corpus to be suspended in cases of rebellion or invasion when the public safety requires it. The Founders understood that defending the public safety against foreign enemies and domestic rebels so why doesn't Barack Obama?

The man is a dumb a## and a danger to us and himself. Obama the global president feels everyone in the world has the same rights as an American citizen. Don’t mock the constitution! coming from a man I doubt knows whats in it. This is a man we want to lead our country?
He will inflict unmeasurable damage if this comes to pass.

Or may be he's both, so what you're saying Barack is that you would kill the terrorists; take them out, burn them, ect. BUT first would ask them for ID and read them their rights? This guy is losing it.

I estimate the O’s IQ at about 90-100. He’s quite ignorant and not far from being stupid. He didn’t “get it” that Sarah was making a jab at the doofi (is that a word? it is now!) who think terrorists should get Constitutional protection of their rights!

Palin’s response should be: “Senator Obama says that the question of whether unborn American babies have rights is too complicated, that the question is so difficult it is ‘above his pay grade.’ But not the rights of foreign terrorists trying to murder Americans. So if we catch a guy on a battlefield, we’ve got to give him a right to file a writ of habeus corpus in order to assure that we are not arresting a mere cab driver, or a Democrat running for President?
