Obama to Palin: 'Don't Mock the Constitution'

FARMINGTON HILLS, Mich. -- Sen. Barack Obama delivered an impassioned defense of the Constitution and the rights of terrorism suspects tonight, striking back at one of the biggest applause lines in Republican vice presidential nominee Sarah Palin's speech to the GOP convention.
It was in St. Paul last week that Palin drew raucous cheers when she delivered this put-down of Obama: "Al-Qaeda terrorists still plot to inflict catastrophic harm on America and he's worried that someone won't read them their rights."
Obama had a few problems with that.

Calling it "the foundation of Anglo-American law," he said the principle "says very simply: If the government grabs you, then you have the right to at least ask, 'Why was I grabbed?' And say, 'Maybe you've got the wrong person.'"
His reasoning here is flawed. Prisoners taken on the battlefield are not entitled to the same rights as criminals. This has never been the case at any time. If these people taken on the battlefield were subject to the protection of the Geneva Convention then they would be given the appropriate rights. They do not, however, qualify for those rights (article 4, section 2). The people in question are subject to neither criminal rights or Geneva Convention rights. I am not aware of any US or international law that would give them habeas corpus rights.

I heard audio from one of those rallies on the radio as part of the news. The audience for ZERO sounded as enthusiastic as it would have reporting to probation officers. Dead.
“1500 people here, 250 people earlier today. Thats two rallies in MICHIGAN of all places, and Obama pulls in less than 2000 people.”
From 85,000 to 250 in two weeks time. Talk about a washed up rock star.

He didn’t really say: “My position has always been clear: If you’ve got a terrorist, take him out” ...but also says “captured suspects deserve to file writs of habeus corpus”.

The safeguard is essential, Obama continued, “because we don’t always have the right person.”
“We don’t always catch the right person,” he said. “We may think it’s Mohammed the terrorist, but it might be Mohammed the cab driver. You might think it’s Barack the bomb-thrower, but it might be Barack the guy running for president.”
So it’s eaither kill them outright or extend them the full rights of US citizens. WTF?
He believes abortion was a right given to us by our founding fathers, y'know, the same guys who talked about LIFE, LIBERTY, AND THE PURSUIT OF HAPPINESS? Wait.....isn't LIFE the first thing mentioned in the DoI?

You know, the Harvard Law School class of 1991 must have produced a fair number of lawyers, many at top-ranked firms, academia, government, or business, who would have something to say about Obama’s reputation and performance there.
Yet I can’t recall hearing from any of them.
Why wouldn’t they take the opportunity to publicly praise him?
The right to not incriminate yourself is in the Constitution. “I decline to answer, Senator, on the grounds I may incriminate myself.”

Good question. He can’t seem to shake loose this bulldog with lipstick and focus on McCain. He’s quite rattled. I think her response should be, “Hey, I’m not the one being sued over the constitutional eligibility of my candidacy. Why don’t you release your birth certificate to everyone?”
But what do you expect? He was speaking to a group of doofi.
