Technically, I belive you are correct, however, the NYT can not claim First Amendment protection if it KNOWINGLY prints material that is illegally released. Palin could then file a lawsuit against the Times. I would bet that this story was sent to the Times legal department and they would know the information was gained as a result of a HIPAA violation.
A good corporate attorney should advise them to keep at arms length away from this, but the Slimes being what they are, probably decided to go with it anyway. I think there could be severe CIVIL ramifications if it shown that the Slimes knew it was protected information and they published it anyway. Further, I’d like to see the Palins hire a lawyer...say like Dr. Levin to pursue this in a court of law. Heck, maybe even Allen D. would love to take a chunk out of the NYT.
The Good Dr. Levin has threatened to do this before.
I am sure he would be MORE than happy to take this job.

I “do hope” that NY Times photographer puts a diaper on that baby's exposed front BEFORE a “change” is necessary on the photographer's front end, camera, and hairpiece.....
imagine how the illegal disemination of an abortion record would be treated by a conservative newspaper....

You know, I sometimes wonder if there is a ‘mole’ in the NYT that actually WANTS McCain/Pallin to win! I can’t explain it, but I wonder if they’re doing all of this just to cause people to defend them, then they win. Some people just want to cheer the underdog. Either or that, they perceive them to be the winners and want to get on the good side! There’s sometimes a “method to a madness”.
On the other side, they might be thinking that the other side is going to win, and wanting to get on their good side! Who knows? They’re just too obviously wallowing in all of this mud for some reason.

But it’s hard for docs to figure out if the water bag is leaking or if something else made you wet. Usually we check the PH etc to tell.
Instead of going to an ER to get checked, Palin went home.
She was indeed leaking, and after arriving home she either went into labor or was induced (more probably the second).
As a doc, I’d say go to the ER, but as a doctor who worked for years with the mentally disabled, I would worry about delivering a Down’s syndrome baby with a strange doctor...if for no other reason that some docs would let it die...
