RNC use of 'Barracuda' as Palin theme song angers Heart

John McCain's campaign has suffered a Heart attack -- of the legal variety.

TMZ.com is reporting that Ann and Nancy Wilson are upset that their 1977 rock hit "Barracuda" was used without their permission in the Xcel Energy Center at the Republican National Convention in St. Paul.

The Heart duo has "fired off a cease and desist letter" to the McCain/Palin campaign, the gossip website is reporting this morning.

They actually wrote a song about a woman who has a one night stand and keeps her baby. But it was written from the aspect of that she kept it because she remembers him being a hunk and the sex was good.

Hmmm - I am seeing them Sunday night. I wonder if the wife and I should wear McCain/Palin shirts to the concert? :-)

Better yet, sneak a "Vote Palin" banner in and unfurl it right when they start that song. I would have the aforementioned "Just shut up and sing!" on the back in case they go into a tirade about it. Please post and after-action picture or video.

Yes, you can. See Title 17, Chapter 92 and the section that limit exclusive rights to holders of copyright. See particularly Compulsory license for making and distributing phonorecords.

There are also examples of patent holders being compelled to grant a license, over their express objection.

Me too... I thought "I hope they got permission to broadcast this cause there's gonna be heck to pay if they didn't".

An artist has intellectual property rights over what he creates. Are you questioning that? Not when they assign those rights to a licensing agency such as ASCAP or BMI, in this case they have assigned the performance rights to ASCAP, thus anyone who has a paid ASCAP license can legally play the song to a crowd.

Reportedly, one of the sisters was so incensed that she sent a personal missive to McCain, asking him- “How do I get you alone?”

They had no problems when Obama and Rezko wanted to use it. However, they were under the mistaken impression the song was How Do I Get You A Loan.

Actually, it wasn’t Chrissy who had the problem, but others who called on her to do something about it being Rush’s opener. .

In fact, she was cool with it, and rebuffed her friends and other types who wanted her to force Rush to pull it.

She had some rather pithy quote at the time, but I don’t recall it.

The way I figure it, if I buy it I have the right to play it as loud as I want.

You do, generally. But that right does not extend to playing it as part of a public performance. If you go to a sporting event, all of the songs they play during breaks are only allowed because of a license fee paid by the venue. It's the same when it comes to something like a political convention.

It’s too bad Heart is doing this; this could have been a windfall for them. They may be able to stop the use of the song, but they cannot stop her nickname from being Barracuda.

On the other hand, it really makes you wonder what chain of fools selected and presumably got permission to play “Chain of Fools” at the DNC. That has to be the most laughable convention song selection ever!

Yes. That is why bars pay a licensing fee to the organizations that handles royalties for performing artists.

When you buy a cd, you don't own the music on it- you just have a license to use it in certain ways. Public performances are not covered by the license.
