John McCain's campaign has suffered a Heart attack -- of the legal variety.
TMZ.com is reporting that Ann and Nancy Wilson are upset that their 1977 rock hit "Barracuda" was used without their permission in the Xcel Energy Center at the Republican National Convention in St. Paul.
The Heart duo has "fired off a cease and desist letter" to the McCain/Palin campaign, the gossip website is reporting this morning.

“but if they had any say, the Pretenders would have sued El Rushbo long ago for his theme song. “
Speaking of “shut up and cash the check”, I’m sure Rush has paid for a bunch of SUVs and mansions (and coke) with royalty checks to Petty...
What? Heart has no heart?
theres a shock...not
The Pretenders have stated they don’t like the Godfather using the song and that “the band doesn’t support” things he espouses.
I don’t know if they have sued or not, but I know they are not fans of his.
Will you be wearing pants over the shorts?
Nancy’s not looking too bad for a 54 yr old who’s probably lived pretty hard.
Ann has become what we call a “run stopper” in football.
She was fantastic!
The Alice in Chains performance is better than the Heart original.
The artists are right and the RNC is wrong. You can’t use someone else’s intellectual property without their permission, and “Barracuda” is doubtlessly still under copyright.
Having said that, it might have been in the artists’ interests to let it go, because the RNC effectively gave them advertising worth six figures if not more. The publicity would probably have led to increased album sales (and royalties). As someone (PT Barnum or Cecil B. DeMille, I’m not sure which) once said, the only bad publicity is no publicity.
I think it is funny that Candace Bergen is scared...Talk about out of touch. Pallin and even McCain know what real people are. Hollywood so called stars are sinking their own boat. I can’t hardly stand to watch many movies these days
Not necessarily. Rights to songs get sold all the time. Michael Jackson owned the Beatles catalog at one time. John Lennon owned the rights to some disney songs or something similiar.
Typical DemoLiberal no class, white trash, subservient to the DemoFeminazi Agenda of being selfish drunkie/junkie baby butchers, and, subservient to the “Deathocrat Party”,..uhhhm.. females.
Neither one of them is worth the price of the garbage bags to throw them away.
OK, hippies.
Turnabout is fair play.
Shouldn’t some 17th century British naturalist who named this particular fish, sue Heart for usurping the name “Barracuda”?
she’s built more like an offensive guard....low to the ground; huge thighs and butt...
Technically, they are right. I dunno the legal details, but publicly playing a copyrighted song requires paying a royalty fee (or, I suppose, requires the indulgence of the copyright holder in NOT getting paid), doesn’t it? Particularly if the song is put to a “featured” or thematic use as opposed to being played just in the background (among other songs)?
Unless you've actually read their contract then you are making an assumption and shouldn't go there. Have you?
WTH is “Heart”?
I was going to go out & buy a Heart cd.
I’m sure there were many people who were thinking about it.
Not anymore.
