Apparently, Ann and Nancy Wilson are suing the McCain/Palin campaign over use of "Barracuda"

Ann and Nancy Wilson are pissed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.

Specifically, the Heart women are upset that the GOP has used their classic "Barracuda" as a theme song for Sarah Palin. TMZ obtained a statement from Heart's rep, who says "The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission."

The statement goes on: "We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored."

We're told Ann was watching TV today and heard the song at the convention when Palin was touted.

I'm pretty sure if it is played on TV, you do. It's called a Synchronization and Performance license. The publishing company can deny such a license.

It's different than recording a cover on a record--that's called a mechanical license and it's automatic by statute.

Part of the rationale for the distinction is that putting a piece of music or song with visuals, or with lyrics other than those originally intended, may cause the music to be associated a message with which the composer or songwriter does not agree. A mechanical license only allows for 'innocuous' reproductions; if the person doing the recording wants to add his own 'message', a sync license is required and may be denied.

That having been said, many composers have signed deals with ASCAP or BMI. Those agencies have fixed payment schedules, and will grant performance rights on payment of royalty with far less concern for context than what composers who control their own copyright might express. If a composer signs with ASCAP, he forfeits control over his music in situations like this.

Yep. It was originally recorded by Jackie DeShannon. And bombed. The Searchers heard it in Hamburg being done by Cliff Bennett and the Rebel Rousers, and they ‘nicked’ it. They then had to fight with their label to get it released as a single. When Tony Jackson [the Searchers’ bass player/singer] split, he was replaced by Frank Allen, bassist with the Rebel Rousers.

The Searchers covered a second De Shannon tune [she also wrote it] called “When You Walk in the Room”. Her version sank. Their’s didn’t.

Smart move for her. I went all over town looking for the CD with My City Was Gone on it when Rush started using it. I paid money for the CD. Something her liberal friends normally don't do when they want a song.

I’ll bet the Republicans purchased the rights for the use through some company who was licensed to give permission and arrange for the royalties. I’ll bet they don’t have to go to the artist for permission.

That is a gorgeous pic of Grace. And her voice was like silk (well, except for that time in Germany)

I always loved her quote of why she no longer performs on stage; cracks me up...

I don't like old people on a rock-and-roll stage. I think they look pathetic, me included.

The answer is yes they do and have had to for a long time. They even are supposed to pay royalties.

It depends on who owns the rights to the song. some groups keep the rights to their catalog. Michael Jackson owns (or did own) the rights to all the Beatles Apple songs.

You have to obtain permission, and the owner gets to determine the fees.

BTW, I thought I read that Sarah Palin does NOT like being called Sarah Barracuda. So why not honor her request, and eliminate the problem.
