PHILADELPHIA - A Lafayette Hill lawyer who filed a legal challenge to Sen. Barack Obama's presidential candidacy claiming he doesn't meet U.S. residency requirements had a motion for a temporary restraining order denied Friday.

Though the motion was denied, Berg said he was encouraged that Judge R. Barclay Surrick did not dismiss the lawsuit. The litigation also sought "expedited discovery." "We're still waiting to serve the senator," Berg said in a telephone interview Wednesday. Discovery would include examining the candidate's birth certificate and adoption papers, among other documents, Berg said.
Besides Obama, the Democratic National Committee (DNC) and Federal Election Commission (FEC) are also named as defendants.

Once the senator is served, Berg will be able to move the suit forward in court. The case is still "very alive and active," according to an e-mail message from his office.

If I’m not mistaken, papers in a federal suit can be served by a U.S. Marshal, who’d have far better access than the typical process server.
As I understand it Kenya has a law referred to as the
“Right of Soil” and “Right of Blood”. Therefore anyone born on Kenyan soil or due a Kenyan citizen is a citizen of Kenya. Either in Kenya or in Hawaii Obami is a Kenyan citizen via his biological father. The plot thickens....
His stepdad and Indonesia could bring in a thousand flying garudas, six Greek Naids, and a partridge in a pear tree and NONE of that would count.

But a green card is not the same thing as citizenship and citizenship is not the same as natural born citizenship.
If they were born in the US then they would not be returning with a green card. They are US citizens.
This seems strange to me.
Indonesia does not allow dual citizenship(unlike the US which does)and to become an Indonesian citizen you must renounce any others. Obama's stepfather or mother would have had to renounce Obama's because he was to young to do it himself, nonetheless he could not become a citizen of Indonesia and remain a citizen of the US.
If there were any legs to all of this the Clinton’s would have been all over it like white on rice during the primary and Hilary would be the nominee. There is no way that ruthless politicians with legal teams and opposition researchers as good as their’s would fail to jump on this particularly when the rumors were already out there.
What he has to do is prove he was born in Hawaii as he claims. He hasn't done that yet. You would think he would welcome this court case and a chance to put this behind him, IF he was born in the US, the only reason I can see that he has planted fake COLBs on the internet(twice,one without number, the same one done over with number)is because he has no original BC to show. Needs to be clarified, the burden of proof is on him, not us.
You have to grab the attention of the courts, or ICE, first.
There is something more to all this than whats on the surface because none of what is known would make someone HIDE this information.
Its what is still hidden that is the problem for Nobama-thats what needs to be discovered-
He just isn’t WHO he says he is, thats the reason for the forged certificate. no telling what his mom really did-and who this person claiming to be Obama REALLY IS-

With all due respect to Her Thighness, she seems to have run a pretty shoddy campaign in many respects -- dirty tricks being one of them.
It was neither the Hillary campaign nor "deniable" minions that exposed Rev. Wright, or William Ayers, or to Frank Marshall Davis, or ties to Muslim terrorists, etc.
To date, neither side has exposed Obama's ties to Shepard Fairey.
So much for Hillary's "researchers" and "strong arm" tactics.
I also believe that -- even up to the last minute -- Hillary hoped that if she could just persuade a few super delegates to win the top slot, she would choose BHO as her running mate. Hence she wanted to defeat him, but not knock him off the field.
The naysayers to this suit who attempt to refute individual parts of it either err in their evaluation of their chosen single-item, or miss the overall thrust of the case: Berg is using a “shotgun” assault on Hussein’s dubious eligibility by simultaneously attacking and demanding investigation of every single questionable and murky, flimsy legal claim Hussein has to purported “natural born citizenship.”
There is the apparently forged COLB on the Daily Kos and Obama websites.
There is the birth certificate reported to have been found in Mombasa, Kenya, last February by GOP operatives issued for a Barack Hussein Obama, Jr., dated Aug. 4th, 1961.
There is the Indonesian exclusive(as opposed to dual) citizenship based on Hussein’s residency, school enrollment, and Soretoro adoption.
There is the absence of documentation of re-establishing U.S. citizenship by swearing an oath at a consulate or embassy, etc., assuming any erstwhile U.S. citizenship in the first place.
There is the trip to Pakistan in 1981, presumably on an Indonesian passport.
There is the comprehensive issue of divided loyalties among two foreign nations and the U.S., even if Hawaiian birth can be “proved.”
There is the history of the intelligence agencies of Kenya, Indonesia, Britain, Australia(and who knows who else) having extensive files on Hussein’s parents, based on the communist activities/agitation of both in past years...this indicates a grave liability that our POTUS could be subject to blackmail by foreign governments, and so on.
The point being, Berg’s case is highly compelling if for no other reason that there is SO much smoke that the judiciary has no choice but to send every engine/hook-and-ladder company and firedog in a 100-mile radius to what just may turn out to be the Chicago Fire itself.
Berg may be a 9/11 conspiracy whackjob(part of his CV other than former Deputy Attorney General for Pennsylvania), but as far as this case goes, I think he’s right on and has my total support. And I wouldn’t be surprised if he’s at least in part a Clinton proxy—he’s as much as plainly said so.
I just pray that he stops Hussein, the N.O.I. sleeper.
