WASHINGTON (AFP) - UN Secretary General Ban Ki-moon issued a last-minute appeal to the United States Tuesday to halt the scheduled execution of a Mexican national sentenced to death for murder in defiance of an International Court of Justice (ICJ) order.
Jose Ernesto Medellin, 33, was due to be executed by lethal injection at 2300 GMT in the state of Texas. He was convicted of the 1993 rape and murder of two teenagers and is one 51 Mexican nationals on death row in the United States.
Less than 12 hours before Medellin's planned execution, Ban called on the US government to abide by an ICJ ruling calling for the executions of all Mexican nationals to be suspended.
"All decisions and orders of the International Court of Justice must be respected by states," Ban warned on local television in Mexico City where he was attending a world AIDS conference.
"The United States should take every step to make sure the execution does not take place," he added, saying he had taken all the necessary steps to delay Medellin's execution, detailed in a letter to the United States and that he was "confident" his demands would be accepted.
Mexico has complained that its nationals on death row were not informed of their right to consular access and assistance during trial, a right under the Vienna Convention.
Medellin's family anxiously waited at the prison near Houston where the 33-year-old is due to be executed at 2300 GMT by lethal injection.
Medellin's request for a reprieve was unanimously turned down on Monday by the Texas Board of Pardons and Paroles and his fate lies in the hands of Texas Governor Rick Perry.

This murdering animal should have been put down years ago. God forgive me if I sin in so saying, but had it been my daughter, he would already be dead. I may have ended up in prison...but such a murdering animal would not have lived off of society for years, and would not be making such a spectacle now.
Forgive me my directness, but what this individual and his cohorts did is beyond imagination and evil, and they all should long ago have been executed for it. Having raised three daughters my dander and anger is worked right up over this story and the disgusting attempts by these foreigners to subvert justice.

They need to show the cajones to stand right up to the UN, the World Court, Mexico, and anyone else who tries to usurp our soverign authority in a case like this where this murdering animal and his accomplices killed two little girls BRUTALLY.
I’ve seen some reports of this on the web that says Texas is waiting for SCOTUS to review the appeal, but no stay has been issued. In other words Texas is voluntarily waiting to see if SCOTUS will grant a stay, but is under no binding condition to do so; and can fry this POS whenever they want. Anyone here know if this is the case?? I’m getting conflicting readings on this.
This case happen in my town and every Houstonian is on their toes tonight.

The Supreme Court Justices who are reviewing this case tonight need to get off their back sides and get it done so the midnight deadline can be met.
I’m not sure they are doing anything with it tonight. This was filed on Friday and still no answer according to the snip I posted in #239 above.
You to understand Mr Good Hair the Governor. He comes out pro Death Penalty all over the networks on this case but the fact remain he will not make a move until his good friend Bush tells him too.
What has this country come too for an illegal to have better protection under the law than an American Citizen.
I have heard it both ways but do not know If Texas can go ahead...I sincerely hope they will.
I believe the Justices, in a case like this, will be reviewing it tonight.
I am not sure to this point whether an official stay is in place or whether the State of Texas is waiting to see. I believe with all that has been said and the publicity regarding it, that if there was no stay, then Texas would alredy have acted.
We shall see.

Maybe a justice is stalling until midnight.
Houstonians, all Texans, and all Amerians should be up in arms over this case. 1st because it was a brutal murder of two innocent little girls by a gang of animals. 2nd because of the abject way foreign powers are trying to dictate to us how we handle such atrocious crime.
To the murders, I say, put them down and send them on the the next life where they can be appropriately judged by a higher authority for an eternal consequence.
To the foreigners I say, MOLON LABE!

From the link I had posted above.. Appears they are awaiting an answer from the SCOTUS for either a stay or a rejection of the appeal. All they have to do is hold out until midnight Texas time and they in effect have granted additional time as the execution date process has to begin all over.
