What happened to justice in America? It certainly wasnt served on July 28 when the 5th U.S. Circuit Court of Appeals upheld the unjust convictions of Border Patrol Agents Ignacio Ramos and Jose Compean. As it stands today, these two brave border protectors must now serve out their full 10-plus-year sentences for shooting and wounding a Mexican drug smuggler they encountered while he was carrying a million-dollar payload of narcotics along the Southern border in Texas. What started off as simple procedural mistakes by the agents has turned into an unimaginable travesty of justice unlike anything Ive ever seen in my 30 years in Washington, D.C.
Its difficult to reconcile why U.S. Attorney Johnny Sutton would choose to seek out drug smuggler Osvaldo Aldrete-Davila, in Mexico to offer him immunity, unconditional border-crossing cards and free medical care in exchange for his testimony against the border agents. Ramos and Compean did not wake up the morning of Feb.17, 2005, with the intention of committing a crime, unlike the illegal alien drug-smuggling victim. They put on their uniforms, strapped their weapons around their waists and pinned on their badges, as they had for five and 10 years respectively, with the intention of patrolling our borders to protect America.

The only opinion that counts, is the one given by the 12 people charged with rendering the verdict. It was upheld. Mandatory sentences, law of unintended consequences. I don’t care what you say, there has to be one set of rules for everyone, not special ones for LEO. If anything they need to be held to a higher standard since they are given such awesome power.

The agents lawyers said they will seek a rehearing before the appeals court and are prepared to take the case even further if necessary.
“I think its far from over,” said Dallas attorney Bob Baskett, who represents Compean. Ramos attorney, David Botsford of Austin, said that if the rehearing efforts are unsuccessful, “then Ill take it to the Supreme Court.”

Justice traded places with illegal aliens. Justice went south when illegals came north as cheap labor.

Shakespeare was right. America is overrun with lawyers. Lawyers care only about winning. Ergo we get absurd immunity agreements like this one and information hidden from a jury.

I agree with your opinion. And there is malfeasance on the behalf of the prosecutor. Ramos and Campeon should easily win in appeal but I suspect they will be pardoned this fall in any event.
Our nation is in a scary place, ccg, if this wrong isn't righted.

Now, its time for Bush to either pardon Ramos and Compean....or be impeached for treason. Supporting illegal alien dope dealers over US law enforcement is treason.
It is anti-American to value the rights of illegal aliens over the rights of Americans. Especially if the illegal alien is hauling drugs, and law enforcement is trying to stop them.
Obviously there are pro-illegal/anti-American liberals in here posting...you keeping seeing the same BS “12 jurors voted, and thats the way it is” (the jurors were withheld evidence) and “they used a gun butt on the illegal”. I guess using “but, we got to be nice to illegals” is running out of steam.
This case makes me sick....and if there is no pardon the GOP can kiss my votes goodbye

The, Welcome to Aztlan. I hardly no where to start so I will address the “shot without justification” aspect of your post.
What we know is that a weapon was discharged. We know that an alien criminal was fighting with Border Patrol Officers and fled. We know officers discharged their weapons but didn’t believe they hit their target. I suppose it may have been the whole “suspect running to a car” that lead them to believe they had not hit him.
All we know is that this criminal alien might have been shot. A big time drug runner that so loved running drugs that he could not suspend the activity even during the period of his immunity to testify. There were no ballistics provided and I find it very hard to believe a surgeon would not have saved the bullet for ballistics testing. It is also not beyond belief that a drug runner was shot in Mexico by a rival or for a variety of other reasons.
There are murderers who are not serving ten years and will be out of prison in less time. The officer fired at him because they thought he had a weapon. There is no way to prove they didn’t think he had one. Since he escaped into Mexico there is absolutely no proof that he didn’t have a firearm or that he was shot by these officers. This was a miscarriage of justice. Of this there can be no doubt. This was a snow job from the word, “go”.
They likely won’t win, even on further appeal. The trier of fact, in this case the jury, decides what facts are worthy of belief and weight, and their findings won’t be overturned on appeal abuse of discretion, proof of prosecutorial misconduct (concealing evidence from the defense) or newly discovered evidence. Since the defense knew about the evidence but couldn’t get it in, it won’t enter into the court’s decision absent the above abuse of discretion.
