What does it take to get a first degree murder charge in Canada??? The murder must be:
- planned and deliberate,
- contracted,
- committed against an identified peace officer,
- while committing or attempting to commit one of the following offences:
- hijacking an aircraft,
- sexual assault,
- sexual assault with a weapon,
- aggravated sexual assault,
- kidnapping and forcible confinement, or
- hostage taking
- while committing criminal harassment,
- committed during terrorist activity,
- while using explosives in association with a criminal organization, or
- while committing intimidation.

Doubtful from the descriptions of what went down that even in Vermont there would have been a likelihood of stopping this. If the perp is a paranoid schizophrenic, as seems likely, he wouldn’t have been intimidated, and he attacked a sleeping victim.
As supportive as I am regarding CC, I have to admit that there’s little chance it would have turned out much different, except possibly with perp and/or innocent bystander injured/killed.

Well, cutting the head off somebody you don’t know in front of other people and then displaying it as a trophy is generally considered “terrorist activity” as its purpose is pretty clear - to terrorize.

blog says hes a Chinese MuslimThe cited blog reports an allegation that the CBC had put up a report to this effect, and then removed it. So it's nothing substantial.
For my part, I have other suspicions. In particular I wonder if there hadn't been some kind of encounter between the two, noting that they had just made a rest stop. At any rate, we may trust that there is a reason for everything.

The very first stab may have been totally disabling and fatal. Seems the poor guy was sleeping and never knew that it was coming.
Bottom line: The scene would be shocking and chaotic. Likely there were numbers of frantic, hysterical people, milling around, trying to make their escape from the proximity of the attack. A bystander/defender would probably have one chance to stop the attack before the attacker turned on the that person with the large hunting knife. I doubt that the victim, in this case, had any opportunity to defend himself.
