I believe only after the convening authority for his court martial reviews the conviction and sentence. That would, in his case, be the nearest commanding general officer (his division or base or whatever major command has general court martial convening authority).

Headline “Bush approves execution” seems to have been manipulated by an AP writer who doesn’t like Bush and is against capital punishment. I think the normal wording is that Bush decided not to intervene in the sentence.

We had a second class PO get booted from our ship in Subic Bay in the Philippines, and his rate and awards were stripped at sentencing before he was sent ashore to the base brig and transfer to CONUS. I just thought that was standard for a felony or dishonourable discharge. Of course, that was also during the 60's, and the rules have been wussified since! ;^)

Why wasn’t prosecuted by North Carolina civilian authorities? I thought the military generally ceded jurisdiction in these kind of cases.

Colonel, another article on this subject stated that the execution would be carried out by the US Bureau of Prisons. They use lethal injection.
