(Mumia) Abu-Jamal loses latest appeal for new trial

A federal appeals court yesterday refused to reconsider the decision denying a new trial for Mumia Abu-Jamal in the 1981 murder of Philadelphia Police Officer Daniel Faulkner. In a two-page decision, the U.S. Court of Appeals for the Third Circuit denied Abu-Jamal's request for a rehearing of his appeal in the controversial case, which has helped fuel an international debate about the death penalty.

Abu-Jamal's lawyer, Robert R. Bryan of San Francisco, said he planned to ask the U.S. Supreme Court to consider the case.

In March, a three-judge panel of the Third Circuit left intact Abu-Jamal's conviction but said a new jury should decide whether he deserved death or should be sentenced to life behind bars.

Deputy District Attorney Ronald E. Eisenberg said no decision had been made on whether his office would ask the high court to reinstate the death sentence....

Remember, Wesley Cook (his real name) was also a Black Panther and a fellow traveler of a left-wing cult called MOVE, and “the man” was keeping him and his brother down (Officer Daniel Faulkner was arresting Cook’s brother when he was shot in cold blood), so the murder of a white police officer was “justified” in their view.

That I believe is the essence of his alibi. "the man was hassling my brother. So I went over to that pig. Then someone without my knowledge or consent grabbed a gun/pulled out a gun (that was linked to me) and fired a fatal bullet at the cop arresting my brother, then with his last conscious act the cop shot ME (even though I was doing nothing!), leaving me bleeding at the crime scene with a dead cop shot by my gun, me shot by the cops gun, and nitrogen residue on my hand as if I had recently fired a gun." Justice Kennedy will look around the world and see that Abu-Jamal's innocence is proclaimed by leftists everywhere, there fore the eighth amendment prohibition against cruel and unusual punishment prevents another trial or even continuing to keep Abu-Jamal in jail. Bryer, Stevens, Ginsburg and Souter will agree but would also support trying the prosecutors and Philadelphia police for crimes against humanity for ever pressing charges against Abu-Jamal.

I know this is going to make a huge difference (sarc), but I won’t set foot in France so long as they have that Parisian street named after the murderer Mumia. I guess they’ll change the Champs Elysee to the Champs d’Obama. IMHO, the only substantive difference between the two is that the big O hasn’t killed a cop (that we know about). What's so baffling? He was an accessory to murder and lucky not to have his ass fried, too. He would be nuts to put his head in the noose to try and save his brother's sorry ass. He could wind up on death row for the rest of his sorry life. Like his lowlife brother, he's only concerned about his own sorry butt.
