It was a stupid fine. It obviously was not intentional on the networks part. Stuff happens. I even doubt that Janet planned it that way, but regardless the networks were not clued in on it and it happened so quickly, it is hard to say that the network did not act responsibly. Now if they would have done slow motion replays on it, that would be another issue.
BS wasn’t intentional... anyone who thinks that was a “malfunction” is dumber than dirt. Choreographed and planned events are not “malfunctions”.

Good! This was a stupid fine, in the first place. It wasn’t intentional. In fact, I was watching that show and working from home. I looked down at my computer, looked back up, and I had totally missed it.
Hahaha.. network knew, they were around during the rehearsals, they covered themselves with some “plausible deniability”, but they didn’t know? Please. There crews were there during all the practices etc etc etc...
If you believe CBS didn’t know, then you believe OJ didn’t do it, and Bill Clinton didn’t either. There is no way CBS had no knowledge what was going to happen. They just kept their “plausible deniability” option open by blaming MTV. This is the same network that now thinks a show centered around swingers is entertainment. Don’t kid yourself for one minute that CBS had no knowledge.
Uh tell it to the judges.......er waita minute someone did and they didn't buy it.
I'd like to see a whole lot more challenges to the unelected arbitrary and capricious bureaucracy in this country.
????? Was CBS sperm or blood on Janet's outfit???? There is no physical evidence that links CBS to having any knowledge. If there is a videotape of a rehersal where Janet's breast is exposed, then yes it would be like denying OJ or Clinton's guilt. But with the lack of any such physical evidence, your analogy falls grossly short of the mark. You can make a circumstantial case, but without physical evidence is it pure speculation on your part.

This event was rehearsed, choriographed, discussed, planned and approved. All of which involved CBS at various levels, and CBS employees were present through all of it.
You want to delude yourself into thinking that this was a conspiracy between timberlake and jackson, fine, you keep fooling yourself. Jackson’s outfit was designed specifically for this act, the choreography was practiced and planned for this act... if you buy into the “wardrobe malfunction” and “no knowledge” by CBS you are indeed a complete fool as far as I’m concerned.

Oh yea, appeals judges are just fountains of common sense and legal scholars (snort). Please don’t even try to make that argument... or we’ll be stuck here for decades citing horrific appealate rulings.
Unless CBS had contractually protected themselves from Miss Jackson's actions, they are the party responsible for preventing objectionable material from being broadcast on their network.
If a drug or food manufacturer were to have an employee contaminate the product, intentionally or otherwise, the manufacturer would still be held at fault if that product reached the market place.
Why would Janet have something covering her right breast nipple, if this wasn’t really supposed to be intentional? The lyrics to the song that they were singing included Justin singing, “I’ll have you naked before the end of this song.” Justin also did some fake groping of Janet throughout the song. How many women do you know that do the exact same things with their breast nipples, just in case of accidental exposure?
You still have provided zero physical evidence. You basis is that since is was rehearsed, it had to be planned. Well there should be plenty of tapes and plenty of eye-witnesses to these rehearsals. I have not heard or seen any evidence that this act was rehearsed with Janet exposing her breast. You have nothing but imagination.
But in reality, such act of terrorism should not be blamed on that manufacturer unless they were negligent. Of course our courts are biased against big companies that have deep pockets, so that is not reality. The deep pockets in this country end up carrying the responsibility, and the guilty party gets nothing.
