Hearing Impaired Customer Suing McDonald's
KHBZ-TV News ^

Posted on 07/16/2008 2:46:12 PM PDT by WilliamReading

Omaha, NE (KFAB-AM) - McDonald's is all ears after a lawsuit from a customer hard of hearing.

Karen Tumeh recently visited a McDonald's in Omaha and tried to place an order at the pick up window at the drive thru.

Tumeh is hearing impaired and she states that she could not understand the speaker at the order menu board. The restaurant told her that she had to go back to the menu board to place her order or come inside.

The lawsuit would force McDonald's to make special accommodations for those hearing impaired so they too could use the drive-thru. A dollar amount of the suit was not given.

A hearing-impaired woman is suing McDonald’s Corp. for violating the federal American with Disabilities Act after she allegedly was denied service at one of the Oak Brook-based company’s drive-throughs in Nebraska.

The legislation in question, Americans with Disabilities Act, was signed by George H.W. Bush.

“Unbelievable! Go inside and order!”

Isn’t that treating her like a second-rate citizen?

The Americans with Disabilities Act was supported by President George H.W. Bush and was a real gift to the Trial Lawyers. The elder Bush also appointed ultra-liberal David Souter to the Supreme Court.

I have a hard time understanding why all the people will sit idling in drive-through lines when you can walk-in and get faster service.

If you work on an oil rig and have greasy clothes or stains, I can understand it, but an awfully lot of people are just too damn lazy to get out of their cars for anything.

..she states that she could not understand the speaker at the order menu board.

Well DUH, she is deaf. Maybe she wasn't aware of the fact because she couldn't hear someone tell her she was deaf?

Don't remind me of the myriad reasons not to vote for John McCain, please.

It is as simple as this.

She wants everyone (those behind her in the line, McDonald’s etc) to pay for her disability.

Rule #1 for Trial Lawyer:

"Only sue those who have deep pockets."

This just ticks me off. McDonald's offers menus in braille - and you can also access this through the drive through window.

The patron (and her lawyer) just want a pay off.

Moreover, the Ronald McDonald House has helped thousands upon thousands of people with hearing and ear problems over the years.

McDonald's World Children's Day raised an estimated $15-20 million to benefit Ronald McDonald House Charities™ and children's causes around the world. More than 100 countries participated in this unprecedented single-day effort to help children in need right in their own communities. While there are countless examples of how this program helped children around the world, here are just some of the ways World Children's Day made a difference..... In Mexico, World Children's Day funds supplied vital hearing aids to 1,300 hearing-impaired children.

Shame on her (and her lawyer).

The restaurant told her that she had to go back to the menu board to place her order or come inside.

Sounds like she went to the window to order, and they told her she had to go back to the menu board. That's stupid, but I don't think sueable.

If ones hearing isn’t good enough even to use the drive thru window, perhaps the person shouldn’t be driving. Drivers need all of their senses. Hearing is an important one.

I do think John McCain “gets it”. The elder Bush was duped by Senator Rudman of New Hampshire, who knew that Souter was liberal. In fact, Rudman still laughs about the deception.
