Leave it to CNN to worry that the Colombian government committed a war crime in its recent rescue of FARC hostages, including former presidential candidate Ingrid Betancourt.

First of all it wasn't an attack, it was a rescue.

FARC doesn't follow any civilized code whatsoever. They are not legal combatants protected by any international convention.

Screw CNN and those making this claim.

In CNN Land, any military action that inconveniences America's enemies is suspected of being a "war crime."

Conversely, no action taken by America's enemies ever merits that description.

Is the kidnapping of civilians, setting off bombs in civilian areas, assassinating political opponents, as the farc does, a war crime? Why isn't cnn doing a big piece on this?

If Red Cross people had knowledge as to the whereabouts of the FARC prisoners, and failed to share that information, they are complicit. They are FARC accomplices and should be charged as such.

So lets just drop this right now.

Everyone in the world had their chance to get these people out the nice way, and either failed or didn’t try.

They’re out now, they’re free, and Colombians should apologize to no one for it.

This is just another reminder for anyone paying attention why the whole notion of criminalizing war is such a misbegotten idea. If a “trial” means anything in the usual civilian sense of the word, your enemy must have an equal legal playing field with you. If that were an acceptable situation you wouldn’t be at war from the first place.

You are at war because an equal legal playing field isn’t sufficient to contain the conflict between you. You are at war because the outcome of a loss in a court of law to your enemy is something you can not accept and perhaps you can not survive.

If law and courts and cops with revolvers are sufficient to the task, you aren’t at war. War comes when you dare not subject yourself to your enemy whatever the law says. Whatever the judge says you dare not subject yourself to your enemy; when that day comes you are at war. At that point you hunt him down, him and anyone who tries to protect him or give him encouragement, you hunt him down and hang him or put him in the ground.

Only then do you let the lawyers out of their closets to resume practicing their craft in a post-war world. Only then.

IOW, when the Guantanamo prisoners appeal to the federal court, you tell the federal court not to bother sitting on the case because no decision of theirs will free the prisoners - you simply will defy the court if it overturns precedent and rules against you.

This, as in so many other cases at a less extreme level (e.g., Scooter Libby) the Bush Administration has declined to do, thereby eroding the power of his office - and national sovereignty in the bargain.

UN Suggests Hostage Crisis May Have Been Improperly Handled

The United Nations is reported to be considering ordering the return of the 60 recently freed hostages of the Revolutionary Armed Forces of Colombia (FARC) to their captors because “their release was obtained through deceptive and dishonest means.”

“The Colombian government agents misrepresented who they were and failed to carry out the agreed upon exchange,” said UN Secretary General Ban Ki-moon.

To carry out the rescue mission, Colombian security forces infiltrated FARC, posing as members who were ordered to transport the hostages as part of a trade for the release of imprisoned rebels.

“If we let this go we run the risk of abetting lies as the basis for international relations,” warned Ban. “Do we really want to go down this path?”
