That is absurd. My cousin went through hell getting in to the Air Force Academy for being born in a French civilian hospital. After all was said and done he was admitted but was informed he could never run for president because he wasn't born on US soil

Let’s save a whole lot of money and conjecture. Here’s what I would do if I were Sen. McCain.
From what I’ve heard and read Sen. McCain is already having HIS birth certificate under a microscope.
At the proper time, all he has to do is make a public statement to the suspicion surrounding his eligibility to be president.
“My friends, there has been some rumors being spread about my eligibility to serve as president based on my birth certificate and where I was born, I understand that it is being looked into by some elements of government.
I also have been informed that my friend and opponent, Barack Obama has also had HIS birth certificate and HIS origin’s questioned and these rumors are flying around the internet as we speak.
My friends, these scurrilous rumor’s and attacks on BOTH of our honesty, our character and out origin’s have to stop now, so I’m proposing that both of us hold a public meeting to present to everyone our indisputable and verifiable birth certificates. I have mine, in hand, as I’m sure does Senator Obama.
When these important documents have been examined and proved they are irrefutable, then we both can get on to debating the issues without clouds of suspicions hanging over our heads.

Most of the world's greatest and most prolific counterfeiters could make the exact same claim...that doesn't mean I'd put a lot of stock in anything they had to say regarding the validity of any given document.

It is said his parents were not married. It is also said his father had a couple of other wives in Africa but no divorces. It really doesn’t matter. If his mother was an American citizen under the laws at the time of his birth, he is an American citizen. There are reasonable and unreasonable doubts. Obama can and should authorize release of his certified birth certificate to the public. Any thing else is not acceptable. He seems to be stonewalling ala Kerry’s military record. He can run but he cannot hide his real birth certificate. Sooner or later, someone with access will get a copy of the real thing and sell it for big bucks. This whole thing is about the presidency. The public demands clarification of this matter.
Right, 50 states, plus guam, samoa, PR, DC, anywhere else Americans can vote.
A constitutional disaster than would be moved into one federal case.

In reality there is no national election. There are 50 state elections that vote to send electors to the Electoral College.
Additionally, State Election Commissions tend to be conservative in the application of ballot access. Anything questionable tends to be thrown out (that is why nomination by petition is so difficult).
Unless “we” were plaintiffs in the (impossible to sustain) court case I described, “we” have no standing or legal position in this.
If “we’ wish to make the assertion that he is not qualified, then “we” must bring an action.
Some states may require some statement from the candidate that asserts that he is qualified, but I doubt it, because WE DO NOT ELECT THE PRESIDENT but rather we elect delegates pledged to him/her.
This is all a huge non starter.
If there was ANYTHING to it, Hillary and The Pelican would have been all over it months ago.
Disqualifying candidates is a very slippery slope. Elections do NOT belong in the courts.
Simply challenge Obamas inclusion on the ballot fo individual states.Law is about details.
Obama's name is not officially on the ballot. The names of delegates to the Electoral College are. They are loosely bound, if at all, to vote for him when the college votes.
It looks like the time to challenge him legally is when the Electoral College votes.
I'd love to hear a lawyer's view on this.
