It's history of being a Maverick (Sticking the GOP and conservatives in the eye to garner support on the left) IS what we are looking at.
That having been said, this is a good thing on McCain's part.

I know that those of you that use judges as reason to vote for the jerk purposefully “forget” who runs the Senate. Even if the jerk nominated an acceptable judge to you and I, Leahy on the judicial comittee will just say “no” and then we get the Juanito doing what he does best, working with his (actual) political party to (once again) screw America.

McCain can say this now. He knows with a RAT heavy Congress no conservative judge will make it through the process. He can always apologize later that he could not help what the judiciary committee did.
