Abortionists in S. Dakota Required to Admit Abortion Kills a "Living Human Being"

SIOUX FALLS, SD, July 3, 2008 (LifeSiteNews.com) - The United States Court of Appeals for the Eighth Circuit, in a 7-4 decision, will allow South Dakota to begin enforcing a state law that requires abortion providers to tell women, in writing, that the abortion procedure "will terminate the life of a whole, separate, unique, living human being." In Planned Parenthood v. Rounds, the Court vacated a temporary injunction that had been issued by the trial court, which had blocked the law from going into effect.

The opinion addresses the important issue of whether South Dakota can enforce its 2005 informed consent law while the constitutionality of its requirements is litigated in court. Much of the opinion discusses whether the statement, "abortion will terminate the life of a whole, separate, unique, living human being," is truthful, not misleading and relevant to women's decisions to obtain abortions. The majority found that Planned Parenthood had "submitted no evidence" that this statement was false, misleading, or irrelevant.

Planned Parenthood and abortion activists have tried to deny the fact that abortion kills a separate human being. Denial of this fact was part of a national strategy to create a culture of abortion for the entire nation, according to sworn testimony of Dr. Bernard Nathanson, one of the founders of the National Association to Repeal Abortion Laws (NARAL). Today, a majority of the judges on the Eighth Circuit have clearly and decisively declared that South Dakota need not deny the truth.

Harold Cassidy, chief counsel for the two crisis pregnancy centers which intervened in the case, said: "Planned Parenthood, in a shocking, and perhaps perverse logic, argued that abortion doctors were harmed by being required to tell women the truth, and this supposed harm outweighed the damage to pregnant mothers who lost their children because of these doctors' failure to make material disclosures." The informed consent law is designed to guard against the negligence and misrepresentations by providers, since many women would not obtain abortions if properly informed.

The South Dakota law is designed to provide basic information necessary for a pregnant mother to make an informed decision before she gives up her fundamental rights. In the process, it allows her to apply her own personal, moral, and ethical values to the facts once they are disclosed. This fall, the people of South Dakota will vote on a statewide initiative that will ban abortion except in the case where the mother's life is threatened or in the rare case of rape or incest. This voter initiative will be a direct challenge to Roe v. Wade, which sanctioned abortion through all nine months of pregnancy on January 22, 1973.

When the truth about abortion is known, very few women will choose to kill their children."

If this makes it through all the courts, including the SCOTUS, then hopefully more states will also pass a law like this. I just wonder on how will it be enforced? Will there be government moles infiltrating abortion clinics to check to see if they are truly giving out this information? Something tells me that the baby killers will just ignore the law.

People know it does that. I don’t think anyone thinks of a baby as a tumor until it pops out and starts to cry. That’s just sick.

This statement of honesty won’t make any difference whatsoever. I know more than 2 women that have aborted babies because it interrupted their vacation plans that year (I’m not joking)

Considering the reports of baby killers ignoring laws requiring them to report incidents of statutory rape and covering it up, it wouldn't surprise me to find out that your prediction is prophetic.

I agree but that will likely backfire b/c of one reason...lawyers. Many woman regret/end up facing what they have done "in ignorance" and all it will take is for one of them to sue a clinic for not being told the, legally required, truth.

Hey maybe lawyers are useful for something. JK! (sort of)

Wow. This is huge. A great step forward. And if it's really 'all about choice', then it shouldn't matter, planned parenthood shouldn't care, but I think they must be fuming. Because they know. Know just what they don't want their 'patients' to know.

Perverse logic is right. The planned parenthood is up to their eyeballs in it. And now they have to face it. At least in South Dakota.

I thought the same thing. I think a lot of women already know what abortion means and most even feel sad about their actions BUT their own desperation, selfishness and rationalizing takes place and they believe that they are doing or have done is the right thing. In their minds the ends (no matter how lacking it reality it is) justifies the means.

I don’t know, it might save a few lives at the very least. It’s easy to convince yourself that it’s just a part of you when you’re in trouble, and being reminded of that could be enough to stop you if you’re on the fence. Sidewalk counselors have reportedly saved lives just by telling women that and the women actually listening, so coming from the doctor about to do the procedure, it might carry some weight. I’ve also encountered a lot of people who really do think of it as a tumor or growth that doesn’t have a life of its own until birth, or viability, or X random convenient point.

This is the BEST thing to happen for our side in years! I can foresee this making it's way to SCOTUS, but a 5-4 against is likely with the current makeup. Think of it - if the "separate, unique, LIVING human being" passes SCOTUS,HOW COULD THEY POSSIBLY JUSTIFY ABORTION?? THIS WOULD MEAN SANCTIONED MURDER!!!

It is sanctioned murder and God’s word makes it clear what will happen to us, if we as a nation continue to murder babies. If you have time read Habbakuk if you want an interesting read.

Also God makes it abundantly clear that he will destroy the ones destroying these little ones. I Corinthians 3:16-20 addresses this quite clearly and simply.

Women sue abortion clinics all the time, but mostly for botched abortions that leave them harmed. Abortion clinics have been closed for multiple lawsuits, not paying their bills, and other such things. My husband does research all the time around where we live into which abortionists were sued for what. It helps in getting them closed down. Unfortunately, there are still enough of them around to do the dirty deeds. The abortions keep on going despite lawsuits.
