Conservatives warm to McCain on the law (judicial appointments)
The Politicio ^ | June 28, 2008 | Ben Adler

A factor that weighs heavily in McCain’s favor is his Senate record. Judicial issues haven’t been his trademark, but he has consistently supported conservative Supreme Court nominees. In 1987 he spoke on behalf of embattled Reagan Supreme Court nominee Robert Bork, saying he supported him “without any hesitation.” In recent years McCain has voted for every one of Bush’s judicial nominees.

“He voted for Alito and Roberts despite the fact that he had to know they would vote to strike down McCain-Feingold,” said Levey. “That addresses the concern that he might not appoint strict constructionist judges who are more likely to oppose McCain-Feingold.”

Funny, I thought the President nominated judges. If he appoints them why do we have to deal with all those annoying Senators?

The Gang of 14 proves that McCain will only appoint judges that 60 of his pals in the Senate find acceptable. He won’t fight for the Constitution.

As he likes to remind his friends and true base, "I voted to confirm Ginsburg and Breyer, you know."

So what. Generally speaking, the Senate does approve the President's choice for the Supreme Court.

The fact the they were appointed to court is another example of what happens when the “republicans get taught a lesson” -
The country pays.

If McCain does win the Presidency, does that mean he'll have to resign his seat in The Gang of 14?

This could actually be quite amusing. He could nominate someone and denounce him as being an extremist in the same press conference.

Well, "President" McCain would be lucky in one regard. He wouldn't have himself to deal with in The Senate.

“[McCain] voted for Alito and Roberts despite the fact that he had to know they would vote to strike down McCain-Feingold..."

Yet, he said that he would not seek to appoint somebody "like Alito".

McCain says he supports the Bush tax cuts. Yet, he voted against them.

McCain says he supports "border security first". Yet, he authored McCain-Kennedy and is still promoting "comprehensive immigration reform" (as if we all didn't know what that means).

McCain supporters can say all they like about what McCain has said he will do. That's not the issue.

Instead, the issue is can conservatives trust him to do what he says he will do...now?

Twice in less than two weeks he pointed out to Democrats that he likes their sort of judges too. That should raise a lot more alarm flags than it does with the “frog in the slowly heating pot” Republicans.

He also voted for Scalia, Thomas, Bork, and Rehnquist for Chief Justice.

And he voted to confirm Ginsberg, and he supported the Miers nomination.

In summary, McCain has been all over the map on judicial appointments.

Funny, I voted in 2006. I can’t remember anyone I know teaching them a lesson. I am sick of hearing this cr*p. They must have lost out because people are tired of voting for RINOs.

That said, I won’t vote for McCain, but I will vote and support down ticket conservatives.

A President McCain will find himself facing a probably-hostile Dem-controlled Senate. Any nominations would have to be pre-approved by the Dems. McCain, at best, would be lucky to get moderates confirmed. The Dems certainly will not approve any SC nominee who moves the SC to the right.

You actually made me laugh out loud with that one.

GOPers who expect McCain to nominate conservatives to the bench are like betrayed wives - this time he will be faithful... after all he promised...well, he deserves one more chance...

The answer is a resounding yes! He will push to grant amnesty to illegal aliens. He will continue good on his pledge not to drill in ANWR and he will continue to shove the human induced global warming fallacy down our throats with the Lieberman-McCain Climate Stewardship Act.

Thank you. I do try so hard.

McCain can nominate all he wants.
