Probe shows kiddie porn rap was bogus

After poring over the laptop, Loehrs reported to the court “with 100-percent certainty that the laptop was compromised by numerous viruses and trojans, and may have been hacked by outside sources.”

“There is no evidence to support the claim that Michael Fiola was responsible for any of the pornographic activity,” she wrote.

All the porn, she said, was located in the laptop’s cache, a computer feature that stores copies of Web pages. Consistently, Loehrs’ findings noted, there was “no apparent origin or user interaction preceding the pornographic activity,” some of which was downloaded “fast and furious.”

Sounds like they’re flocking to the porn stuff because it’s easy to track? Maybe they should do some more actual police work & investigation.

Funny how porn is legal, but viewing it apparently is not. It sounds like the ultimate gotcha.

Kiddie porn is NOT legal.

This guy wouldn't be in so much trouble if it was adult-only stuff. And if I recall the case, it was not his personal machine, but a work machine.

Adult porn on a personal computer is in no way a crime.

Assuming of course that the porn doesn't depict commission of a crime, etc. Then it gets sticky.

the it department needs a shake up.
1. the loaner computers should be wiped after use.
2. He shouldnt have any rights to install anything infectious
3.network should have blocked him, but then I think he was using an aircard and maynot have been on their infrastructure.

Witch trials is correct. Anyone guilty of propagation of kiddie porn should fry IMO, but at the same time I don’t like witch hunts. I don’t know if the guy is guilty or not. I’ve been in computers and IT work for over 20 years and can tell you that most of these kinds of virus’ come from visiting porn sites and clicking things there. The next large chunck comes from clicking links in emails which tend to be inappropriate. The investigation should dig much deeper, and at the same time his presumption of innocence should be maintained.
