Incredible. Do these people not realize the difference in focus between criminal prosecution and military action? That is, criminal prosecution is largely concerned with punishing acts which have already occurred and can be proved beyond a shadow of a doubt while military action is concerned with preventing future acts of war. While you can punish through the court system attempts at crimes and conspiracies, it is largely ineffective to prevent future acts. Try calling the cops if you suspect a crime will go down soon.

So now we have an assurance from the Obama Campaign that when my city is nuked and I am reduced to a shadow on the wall, the attackers will be prosecuted to the extent of international law. How comforting.

Do you recall in the early days after 9-11, when Phil Donahue went on BOR and pleaded that instead of going to war with AQ in Afghanistan that we should “send in some international police to arrest the perpetrators”?

I think these loony libs want to replace all military action with ordinary police efforts and fight the WOT by sheer force of the badge, which of course strikes utter fear in the hearts of the most hardened terrorist.

No. They still believe that international terrorism is just another crime to be prosecuted like auto theft and shoplifting. They still do not see it as a serious national security issue.

One of the single most important reasons for 9/11 is that starting with the '93 attack on WTC right up to the U.S.S. Cole in 2000, the Clinton admin, guys like Clarke, treated these events as if they were bank robberies. The were sending in the FBI when they should have been sending in the USMC.

To do this again is, as McCain said, "To have a 9/10 mentality will ensure a second 9/11."

These Liberals never cease to amaze me. What will they have us do next? Teach the Iraqi Army the Geneva Convention and our UCMJ? This is sheer stupidity. Anyone, who has ever fought with or commanded foreign troops knows how ridiculous this is.

Club Fed is about right. Like the US prosecutor is going to reveal all the Intel sources used to nab these killers?

How stupid is our Supreme Court? This is the worse decision I can recall.

Obama, Kerry, and the left are out of touch with reality. The message to our enemies is any time you are outgunned-just raise your arms and surrender. You will be back in action soon. The reality is combat troops hate fighting the same SOB twice.

Any future KSMs will say “Oh hello FBI/CIA/DSS/Delta. I want a lawyer and a habeas corpus hearing in DC before I say anything else. Thanks.”

In fact KSM *did* say just that at the time of his capture in Pakistan, he didn’t realize that the rules had (temporarily) changed. So now everything is back to normal, pre-9/11 civilian legalisms and that kind of request must be honored.

BTW, KSM earned his mech. engineering degree in South Carolina, speaks fluent English, and like most AQ terrorists was trained in how to behave if captured.
