MILITARY: Judge dismisses charges against Marine (Haditha)

CAMP PENDLETON ---- A military judge has dismissed charges against a Marine officer accused of failing to investigate the killings of 24 Iraqis.

Col. Steven Folsom dismissed charges Tuesday against Lt. Col. Jeffrey Chessani after defense attorneys raised concerns that a four-star general overseeing the prosecution was improperly influenced by an investigator probing the November 2005 shootings by a Marine squad in Haditha.

The charges were dismissed without prejudice, meaning they can be refiled, but Folsom excluded Marine Forces Central Command from future involvement.

Chessani was the highest-ranking officer implicated in the case.

Thanks for the Ping Jaz..I just finished reading the article in my email from the Thomas More Law Center...It said that Military Judge Col Steven Folsom really ripped the prosecution during his one hour reading of his decision...The case was dismissed without prejudice but it looks very unlikely that it would be reopened since the assertion of Undue Command Influence was so blatant and so widely known...That is a case killer, if any, as it is one of the most serious prosecutiorial defects..Thank God that Lt Col Chessani was freed from these allegations..Next up is Sgt Wutherich and the same principal-UCI- applies in his case, so we pray his charges will also be dismissed..

Thanks for all your prayers, thoughts, and effort to keep this case alive before the public..and thanks too for upholding the honor of the USMC for these fine professional soldiers who hopefully can go on to have good military careers...

This should be a lesson to the civilian politicians in this country too: don’t try and micromanage a war...Fund, supply, apply broad policy, but don’t interfere in the lives of your trained troops if they are carrying out the mission to the best of their ability..Keep in mind that in our military academies, the men and women are taught repeatedly: do not lie...That same principal should apply to military journalists and to politicians who want to create stories of malfeasance where there is none....

Pro-Obama Iraqi-American Ex-Convict Supports Increased Attacks on U.S. Troops

There’s so much vileness here that I really don’t know what to mop up first.

Ayham Alsammarae, Iraq’s slimy ex-Minister of Electricity under the Bremer and Allawi administrations, who had escaped from an Iraqi prison by hiring an American security company to break him out back in December 2006, has resurfaced in the Jordanian capital Amman where he gave a press conference today saying, among other things, that he hoped that the insurgency in Iraq “would continue [against U.S. occupation] and avenges the Iraqi people.”

Alsammarae, an Iraqi-American Chicagoan, added during remarks carried by Radio Sawa (Arabic link) that he had contributed the maximum allowable of $2,300 to Barack Obama’s campaign. But there’s another Obama link to Alsammarae: while serving as electricity minister Alsammarae had been involved in brokering deals in the Iraqi electricity sector for Antoin Rezko, Obama’s long-term friend and patron. Rezko is the Syrian-American hustler who was convicted of fraud in an Illinois court on the day that Obama secured the Democratic nomination.

Alsammarae had been appointed minister under the Coalition Provisional Authority upon the recommendation of senior State Department officials who were involved in Iraqi affairs at the time. After leaving office upon Allawi’s election loss, Alsammarae reinvented himself as a mediator between insurgent groups and the U.S. ambassador to Iraq at the time Zalmay Khalilzad, who in turn arranged for Alsammarae, a onetime Republican Party fundraiser and activist in Arab-American circles, to meet with senior Bush administration officials. He was arrested by Iraqi police in Baghdad soon afterwards, an act that Alsammarae, a Sunni Arab, claimed was motivated by sectarian animosity.

Alsammarae escaped from prison after facing multiple corruption charges brought against him by Iraq’s Public Commission for Integrity; he was sprung from jail by hired U.S. mercenaries and left Iraq on a forged Chinese passport, he flew out to Amman on a private jet almost certainly with the knowledge and connivance of some U.S. intelligence officials. He returned to his multi-million dollar mansion in Chicago and, save for a few press interviews here and there, stayed under the radar. But Alsammarae seems to have been a beneficiary of the Amnesty Law that was recently passed by the Iraqi parliament, which was a benchmark for progress actively pushed for by Senate Democrats in Washington DC, and he’s eagerly touting his return to Iraqi politics, as he did in today’s press conference.

In an astounding and blatantly treasonous assertion for a U.S. citizenship holder, he stated that “the [insurgency] in Iraq is a legitimate resistance [movement] and it is against occupation and any resistance in the world against occupation is considered legitimate, and I hope that the [insurgency] continues and avenges the Iraqi people and I look forward to expanding its political agenda.”

I know there’s free speech and all, but isn’t calling for more attacks on U.S. troops a violation of sorts? Isn’t it ethically reprehensible? If Alsammarae’s citizenship can’t be revoked, can’t he be prosecuted on something else?

I’ve heard that Alsammarae allegedly fled Chicago because the authorities were going to get him on tax evasion. I guess his resemblances to Al Capone’s lifestyle—something that Alsammarae once boasted of in a press interview—go all the way.

Now, he wants more insurgent attacks on U.S. troops. What a slime-bucket, but he’s the same slime-bucket that I’ve always thought he was, from the days before the war when he opportunistically hopped onto the anti-Saddam bandwagon when it began revving up for real.

I had seen part of Alsammarrae’s General Intelligence Directorate file back in Baghdad, and he’s identified as a snitch that had worked for the Saddam regime while he was a student in the 1970s, reporting on the political activities and utterances of fellow Iraqi students then pursuing their degrees in the UK.

In another vein, Alsammarrae also tells Radio Sawa that he’s contributed money to the Obama campaign. I wonder how Obama would react to a paycheck and an endorsement from ex-con buddy of Rezko’s who is now braying for more American soldiers to be killed.

Alsammarrae claimed that he was on his way back to Iraq after being let off the legal hook under the amnesty law, and that he is set to re-join Ayad Allawi’s political coalition.

I don't see where they can go with this even with the option to an appeal or refile. They want to get somebody, anybody, IMO. But the Corps may have had enough of this madness.

Thanks, Bill, for the comprehensive report. I can rest a little easier now.

I was worrying about the Colonel and his close and extended family and his countless dear friends and supporters who would have to live with and under the poisonous fog of charges being brought up again. I agree, the case will probably not be re-opened, but not for want of trying by anti-American vultures.

Praise the Lord and let's make Murtha our mission. Send an email to this loathsome, sorry excuse of a "man" and let him know how you REALLY feel!

Happy Dance continues! Best wishes for LTC Chessani and high hopes for SGT Wuetrich. I've been following the analysis regarding the judge's finding of command influence (which hopefully will impact Wuetrich's proceesings) and the decision to drop charges with prejudice. I'm trying to recall: is LTC Chessani a Marine reservist or regular Marine?

Several weeks ago I made the disheartening observation that Internet rumor-mongering has become, for lack of a better term, "integral" to the political process over the past few election cycles.

It works like this: a smear against a particular candidate erupts on a blog, a message board, or in an email; it spreads as other bloggers pick it up and the email is repeatedly forwarded; and in no time -- a matter of hours, in some cases -- it reaches critical mass and becomes an obligatory topic of discussion on talk radio and cable news shows. Once a reporter jams a microphone in the candidate's face and poses the rumor as a question, there's no going back. It's "news."

Mind you, there needn't be -- and usually isn't -- a particle of truth behind such gossip. If you dial up the buzz it has to be talked about, true or false. And the people playing this game understand this only too well.

Fight the Smears

So, it appears, does the primary target of campaign rumor-mongering this election year, Democrat Barack Obama. Unlike his predecessor John Kerry, who infamously failed to quash the personal attacks that dogged him in 2004, Obama has come out swinging, first criticizing the press for repeating "scurrilous rumors" as if they had legitimacy, and more recently launching a website, FightTheSmears.com, wholly dedicated to debunking misinformation about him, his family, and his candidacy.

The website, actually a refinement of the fact-check page that has existed for several months on BarackObama.com, encourages users to "spread the truth" by emailing information from the site to friends. Topping the list of debunked items at the moment is a smear that bubbled up from the right-wing blogosphere over the past few weeks alleging that Michelle Obama, the candidate's wife, delivered a racist speech at the Rainbow/Push Coalition Conference in 2004 in which she railed against "whitey." The truth, says the website, is that although Michelle Obama attended the conference, she delivered no speeches at all, let alone one that defamed white people.

Short on documentation

The site wins high marks for its combative, no-nonsense presentation, but falls short when it comes to documenting its claims. If I were to offer one piece of advice to the folks running Fight the Smears, it would be to offer proof and cite sources, and do so in exhaustive detail. Denials are all well and good, but it's evidence that makes the case.

LtCol Chessani is a regular Marine and one of the finest from everything I’ve read.

I have to believe the UCI will be a big factor in SSgt Wuterich’s case now that this ruling has come down.

Just guessing, but I'd think the weasely brassholes who supported this circus are going to consider him way too hot to touch, and he will definately be a hero to every Marine following this, which I would expect to be just about all of 'em.

IMO, all the government accomplished by leaving things "open" by failing to dismiss with prejudice, as they apparently also did to Justin, was solidify public opinion that this was a vendetta, an abuse of power by sniveling cowards with a grudge. (been a lot of that going around lately)
