Court order: FLDS children to return beginning Monday, families will remain supervised

SAN ANGELO, Texas — Lawyers for Child Protective Services have made a proposed agreement to return hundreds of children taken from the Fundamental LDS Church's YFZ Ranch.

The agreement is being discussed by lawyers for mothers, children and child welfare authorities in a hearing underway that is in response to a Texas Supreme Court ruling that the children should be returned to their parents.

A copy of the order, obtained by the Deseret News, seeks to have children returned to their parents beginning Monday. The proposed agreement also requires parents to complete parenting classes and cooperate with an ongoing investigation into allegations of abuse and negect on the YFZ Ranch.

"CPS has access to the residence of the subject child for unannounced home visits during the hours of 8 a.m. and 8 p.m.," the agreement says.

Parents must provide the address of the residence and the names of everyone living in the home.

The proposed agreement also seeks to prevent the families from leaving the state of Texas. It applies to approximately 139 children belonging to 41 mothers, but Judge Barbara Walther said in court she expects it will be expanded.

"The court thinks this ruling would be the same for each and every child," she said.

AND stop the welfare checks and foodstamps for this group as well. Talk about enabling!


I’m not sure they ever got the normal welfare type stuff through the State here in Texas. Now there maybe other stuff they are getting through fed contracts etc they have which I think helps fund the FLDS overall.

This hasn’t ended with the court ordered return of the children. CPS is still involved and will be for a while it looks like. The major change is that they no longer have custody of the children. But they will be visiting, following up on progress, looking at their lifestyles, etc. And my guess is the judge since she got her robe singed will also have an interested in the situation. Apparently she is going to make some specifications regarding arrangements when she vacates her order.

Come on, people. Learn to reason just a little bit. Sometimes people will do something they judge to be unpleasant or even against their principles in order to avoid something that is even more unpleasant and even more unprincipled: giving up their children for the coin of pride in saying that they didn't give in.

I would imagine that EVERYBODY at CPS, even the janitor that sweeps the floor at night, is totally frozen right now and scared shirtless to make a decision. About anything.

Not a single court in Texas has tried a kidnapping case within the framework of this particular situation. Kidnapping is a crime

The YFZ culters are probably on the phone now, frantic, trying to find one of the parents of some of those kids that Jeffs took from other families. If not, they'll just forge more birth certificates and take 'em home.

Texas District Judge Barbara Walther has refused to sign an order restoring custody to the parents until they agree to more restrictions than state child-welfare officials have proposed. Walther was directed by an appeals court to reverse her ruling last month putting all children from the Yearning For Zion Ranch into foster case. The Texas Supreme Court affirmed the appeals court's decision Thursday and rejected the state's argument that all the children were in immediate danger from what it said was a cycle of sexual abuse of teenage girls at the ranch

NBC news on the west coast is reporting the deal fell through, and now the court jousting will continue on Monday.

SOMEBODY is gonna get taken to the woodshed over this crap!

This as absurd. Whatever remained of a prosecutable case is now being destroyed by the actions of this judge.

Damn I wonder how much this is going to cost us...

Actually I would think it would be the appeals court that would send them. It's their order she is defying.

I wonder how long it's been since a writ of mandamus has actually had to be issued to a sitting judge in Texas? (Generally the lower court will comply with the order of the higher court, negating the need for the writ to issue).

Walther was taken to the wood shed by the Texas Supreme Court and now she pulls this kind of stunt? Oh my. The parents and children have not been convicted of anything. Sorry, I’m ranting to the choir here. Unbelievable.

Well, it isn’t Monday yet either. I agree with CurlyDave earlier in this thread, CPS should have started immediately to get those children back.

No it's not Monday yet, but they haven't gotten things worked out for Monday either.
(unless something has happened that I'm not aware of)
I agree with the two of you, & think they should already be returning the children.


Work the weekend. (I can hear the gasps of civil servants at my intimating that they should work the weekend. :)
