Denver, CO (LifeNews.com) -- A constitutional amendment that would define unborn children as persons under law and could lead to a major abortion battle will appear on the November ballot. The Colorado Secretary of State's office notified leaders of Colorado for Equal Rights that enough valid signatures were submitted to qualify it.
The measure would define unborn children as persons under state law from the moment of fertilization and it could set off a statewide battle over abortion, embryonic stem cell research and other practices that kill people before birth.
The pro-life group submitted almost twice as many signatures as necessary.
They needed 76,000 signatures to get the measure on the ballot but turned in 131,245 earlier this month. The Secretary of State's Office's random sampling indicated that there were 103,377 valid signatures.
Kristi Burton, a young woman who is the leader of the amendment effort, told LifeNews.com she's excited that Colorado, the site of the nation's first pre-Roe law legalizing abortion, will be the place of the first vote to restore personhood to unborn children.
"The people of Colorado have spoken, the Secretary of State's Office has certified our signatures, and our equal rights amendment will be on November's ballot," she said.
"All humans should be protected by love and by law, and this amendment is a historic effort to ensure equal rights for every person," Burton said.
Burton said the measure qualified in part because of the unparalleled grassroots effort the organization received. The grassroots initiative had over 1,300 volunteer petition circulators.
"We at Colorado for Equal Rights are incredibly thankful for our many volunteers who worked so hard for each signature we delivered to the Secretary of State's Office and the churches who stood behind us and supported us," Burton continued. "This victory is the voice of the people and all credit goes our Creator."
Abortion advocates have already staged rallies and are organizing efforts to defeat the measure at the polls in the fall. They are expected to spend hundreds of thousands of dollars to defeat it.
Pro-life advocates in Colorado are split on the idea with some favoring the proposal and others saying it would be overturned in the courts as unconstitutional and that pro-life groups should continue fighting to change the Supreme Court and overturn Roe v. Wade, which allowed virtually unlimited abortions for the last 35 years.

And this again ties in with battles on judicial nominees to the federal bench. If passed this law will almost certainly be challenged, and federal court interpretations about abortion rights including Roe Vs. Wade could be challanged. Stay tuned.
Obama/Clinton will appoint liberals who will overturn such laws. McCain, hopefully, will appoint conservative judges.

I have an uneasy feeling the MSM will speak loudly and often to defeat this measure, the DEMOCRITICS in congress will pass a bill to squash it, and a loony left judge will declare it unconstitutional.

You are probably right, but the reality is that it is necessary to have such a law struck down. A law MUST be appealed to the Supreme Court if Roe v. Wade is to be overturned.

Its a ground-breaking measure for Colorado. Of course, in this state, the Left will spend a lot of money to defeat it since its dogma is abortion on demand and to write the right to life for the unborn into the state constitution would be a major setback for them. If it passes, a definite win for the Culture Of Life.

I signed this petition at a local Sam’s club. Upon exiting my local Presbyterian church I saw people who refused to sign the petition without a reason. When I saw this, it was kind of disheartening. This is good news though that this his gone through to be put up for a vote.

and if it passes some jerk left wing whackjob judge(s) who probably haven’t read the constitution in 20 years will once again over turn the rule of the people who obviously are too stupid to understand the constitution or the intentions of the founding fathers.

Kristi Burton is 20 years old. She's a remarkable young woman and she took this idea where people looked at her and thought it was crazy, it would never even get on the ballot. It has and I'm proud of my state for being the first in the nation to put a personhood constitutional amendment on the ballot and this is probably the only thing I will vote for in November. Its about time!

... and a loony left judge will declare it unconstitutional. Oh that will almost certainly happen. However, the issue WILL be on the ballot in November, which will hurt the obamessiah in a state that he is very much counting on turning from red to blue.
This is great news!

I checked out Daily Kos. The lib argument is pro-lifers want to protect a blastocyst - a clump of fertilized cells that's not even a recognizable person and they want to outlaw abstinence! There's a difference between something that's not life and has human potentiality, once its fertilized. I'd like to know when the Left think personhood begins. As for abstinence, its funny that the same people who believe in safe sex are now concerned people won't be able to NOT have sex if the personhood amendment is passed. Just wanted to give a heads up on what libs are thinking about it today.

It is a simple, one-sentence amendment to the state constitution:
“The term ‘Person’ or ‘Persons’ shall include
any human from the time of fertilization.”
Wow!

“and they want to outlaw abstinence!”
I’m kind of confused (not hard to do when trying to relate a liberal position! LOL). Which group are those on Daily Kos claiming wants to outlaw abstinence? This just doesn’t make sense at all to me. Maybe I’ll go over to DK later and read the posts - not sure if I want to get that upset tonight though... ;)

My wife’s signature, as well as mine, are on the rolls supporting this initative. Kudos to the pro-life community in Colorado for supporting and moving this important matter.
Don’t color Colorado blue prematurely. Measures like this will bring out the social conservatives.
Too bad so many other states do not have a rallying point like this for their social conservatives.
